It is understood and agreed by the parties hereto that the easement herein described is granted as a peq
easement for the purpose of erecting, constructing, reconstructing, replacing, repairing, maintaining, and operating
system, sewerage. drainage, power line. excavation. and/or embankment faciIities and appurtenances thereto, together
the right of ingress and egress to and from said right of' way by practicaI route or routes in, upon, over, and across
aforesaid lands, together with the right to cIear and keep cIear said right of way from LuiIdings, structures, trees
Lmsh, and any similar surface or subsurface encroachment which may interfere with reasonable and proper use of
right of way easement. The Grantor and successors in estate of the aforesaid lands hereby agree to neither permit nor
or construct any building or structure, pIant any tree, or otherwise create or permit any encroachment which may inte
with reasonable and proper use of the said right of way easement by the Grantee.
It is understood that this grant of easement is on the express condition that grantor shall at all times have the right of ingress and egress upon, over
and across the aforesaid lands and upon the express condition that grantee's
use of said easement shall be in such a manner as to not interfer with grantor's right of ingress and egress for his trucks, automobiles and other vehicles upon, over and across said lands, and upon the further condition that grantor shall have the right to blacktop said lands.
