GRANT OF RIGHT OF WAY ~~

called the "Grantor," for valuable consideration, receipt where of is hereby
acknowledged, do hereby.grant to the City of Carlsbad, a municipal corporation
hereinafter called the "Grantee," an easement and right of way in, upon, over,
under, and across the lands hereinafter described, to place, construct, repair
replace, maintain, and use at any time and from time to time for the transmiss
and distribution of electricity and for telephone service and for all purposes
connected therewith, underground facilities consisting of conduits, pads, man-
holes, handholes, and junction boxes with wires and cables placed therein and
all necessary miscellaneous equipment and material connected therewith, togethc
with the right of ingress thereto and egress therefrom to and along said
facilities, over and across the Grantor's land situated in the County of San
Diego, State of California, and more particularly described as follows:
The Westerly 1 acre of Lot 12 in Block "C" of the resubdivision of a portion of Tracts 238 and 243 of Thwn Lands, in the City of Carlsbad County of San Diego, State of California, according to Map thereof No. 2103, filed in the Office of the Recorder of said San Diego County,
the Easterly line of said Westerly 1 acre to be parallel with tbe
Westerly line of said Lot 12, excepting therefrom that portion described
as follows:
Beginning at the point of intersection of the Easterly line of said
Westerly 1 acre with the Northerly line of said Lot 12;
Thence South 28. 39' East along said Easterly line 150.00 feet to the
true point of beginning;
Thence South 61. 21' West to a point in a line which is parallel with and 25.00 feet Easterly from said Westerly line of said Lot;
Thence South 28' 39' East along said parallea line to the Southeasterly
line of said Lot;
Thence Northeasterly along said Southeasterly line to a point in said
Easterly line of said Westerly 1 acre;
Thence northerly along said Bsterly line to the true point of beginning.
The center line of said easement of right of way in the aforesaid lands is 2.5
feet Westerly of the reference li'ne particularly described as follows:

Commencing at the Southwest corner of said Lot 12; thence North 28' 44 r 48" West, along the Southwesterly line thereof', a distance of 163.27
feet to the TRUE POINT OF BBSIX!JIHG of reference line herein described,
said point being a point on ?he arc of a 45.00 foot radius curve, concave
Westerly, a radial line passing through said point bears South 87' 15' 18
East, thence from said 'FRUE POINT OF BEGINXIE, Northerly along the arc
of said curve, through a central angle of 1' 24' 19,1f a distance of 1.10
feet; thence tangent to said curve, North 1' 20' 23" East, 65.64 feet.
Grantor and their successors or assigns shall not erect or construct, or
to be 'erected or constructed, any building or other structure, plant any tree
trees, or drill any well or wells, within the limits of said right of way.

It is also understood and agreed by the parties hereto that the Grantor and
their successors or assigns, shall not increase or descrease, the ground surfaci
elevations within the above described easement and right of way existing at the
date of the execution of this .3nstrument, without the previous written consent
the Grantee or its assigns,
%e right to transfer and assign this easement and-sight of way in whole or
in part is hereby granted to the Grantee.
