called the "Grantee", an easement and right of way 10.00 feet in width in, up01

the Grantor's land situated in the County of San Diego, State of California, a:

The Westerly one acre of Lot 12 in Block "C" of the
Resubdivision of a portion of Tracts 238 and 243 of Thum
Lands, in the City of Carlsbad, County of San Diego, State
of California, ,according to Map 2103, filed in the office
of the County Recorder of said County, April 3, 1926, the
Easterly line of said Westerly one acre to be parallel
with the Westerly line of said Lot 12.
The center line of said easement of right of way in the aforesaid lands is 2.5 westerly of the reference line particularly described as follows:
Commencing at the Southwest corner of said Lot E; thence Morth 28O 44' 48" Vest, along the Southwesterly line thereof, a distance of 163.27 feet to the TRUE POINT OF BEGIFJMING of kef'ere&e line herein described, said point being a point on the arc of a 45.00 foot radius curve, concave Westerly, a radial line passing through said point bears South 87' 15' 18" East, thence from said TRUE POINT
OF BEEINlgIRG, Northerly along the arc of said curve, through a central angle of 1" 24' lg", a distance of 1.10 feet; thence tangent to said curve, North 1" 20' 23" East, 65.64 feet.

Gyantor and their successors or assigns shall not erect or construct, or
to be erected or constructed, any building or otner structure, plant any tree

It is also understood and agreed by the parties hereto that the Grantor and
their successors or assigns, shall not increase or decrease, the ground surface
elevations within the above described easement and right of way existing at the
date of the execution of this instrument, without the previous written consent of
the Grantee or its assigns.
The right to transfer and assign this easement and right of way in whole or
in part is hereby granted to the Grantee.
