THIS INDENTURE, made this ,? j day of May, 1955, by

existing under the laws of the State of California, hereinafter
referred to as the first party, and CARLSBAP MUTUAL WATER GO"!
a Corporation, organized and existing under the laws of the Stal
of California, with its principal office at Cerlsbad, Californir
hereinafter called second party,
WITNESSETH
1. The first party hereby grants to CARLSBAD MUTUAL WATI
COMPANY the following described reel property in the State of
California, County of San Diego, City of Carlsbad:
That portion of Lot 28 of Carlsbad Estates, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof NO. 3019, filed in the office of the County Recorder, described as follows t
Beginning at the Southeast corner of said Lot 28; thence North 19°12g3311 West along the Easterly line of satd lot, a distance of 42 feet; thence South 70°16'13" West, 35 feet3 thence South 19O12'33" East, 42 feet to the South line of said Lot 28, thence North 70e16t1311 East along said South line, 35 feet to the point of beginning.
2. That the first party, for and in consideration of
Ten ($10.00) Dollars and other good and valuable Consideration
to them in hand paid by the second party, the receipt of which
is hereby acknowledged, does by these presents grant, bargain,
sell, convey and confirm unto the second party, and to its
successors and assigns, the right, right of way, easement and
privilege to lay, build and maintain on, in, under, over and/or
across the hereinafter described real property, for the purpose
of conveying water, one or more services and pipe lines, togethc
with the right of ingress to and egress from said real property
for the purpose of making surveys, locating, putting down, con-
structing, placing, replacing or reconstructing in the same or
any other posftion therein or thereon, maintaining, operating,

connecting with and/or repairing any and all of the above
mentioned items, and for all other purposes that are or may
become necessary and incidental to the construction, recon-
struction, placing, replacing, maintenance and/or operation
of any and all of said items, on the Southerly 10 feet of
the following described real property:
Lot 28 of Carlshad Estates in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 3019 filed in the off ice of the County Recorder of San Diego County.
This grant is made subject to the following covenants
and conditions on the part of the second party, its successors
and assigns, to be by them kept and performed, viz:
That upon the permanent removal from said premises by
the second party, its successors and assigns, of all of the
above mentioned items and equipment, the right to remove which
is hereby granted, the surface of the ground shall be restored
as nearly as possible to its present general condition.
TO HAVE AND TO HOLD unto the second party, its successorz
and assigns,
