HomeMy WebLinkAbout; Hier, John & Gunvor; 78596; Easementaos+5n2 "ICE 32 4L +-J THIS IHDEHTURE, made this 2 day of -3kr&, 1954, by and between JOHN A HIER and GUWOR So HIEEt, husband and wife, hereinafter called first party, and CARLSBAD MUTUAL WATER Company, a corporation, organized and existing under the laws of the State of California, with its principal office at Carlsbad, California, hereinafter called second party, WITMESeiETH That the first party, for and in consideration of Ten rn c$lO.OO) Dollars and other good and valuable consideration - @ t0 them in hand paid by the second perrey, the receipt whereof is hereby acknowledged, does by these presents grant, bargain, sell, convey and confirm unto the second party, and to its successors and assigns, the right, right of nay, easement and privilege to lay, build and maintain on, in, under, over and/or across the hereinafter described real property, for the pur- poses of together property cmveykng water, one or more services and pipe lines, with the right of ingress to and egress from said real for the purpose of making surveys, locating, putting down, constructing, placing, replacing or reconstructing in the saae or any other position therein or thereon, maintaining, operating, connecting with and/or repairing any and all of the above mentioned items, and far all other purposes that are or may become necessary and incidental to the construction, recon- struction, placing ,replacing , maintenance and/or operatlog of any and all of said iteas, on a strip of land consisting of the westerly ten feet of the following described property8 "That portion of Cedar Hill Addition to the Town of Carlsbad, in the County of San Diego, State of California, according to Map thereof #532, filed in the office of the County Recorder of San Diego County Apr. 25, 1888, described as follows: Beginning at the NEI corner of said Cedar Hill Addition; running thence ~89026~~ along the H line of said Addition 731.29 feet to the Be corner of Tract 6, Laguna Mesa Tracts, as shown on Map thereof Mo. 1719; thence S along the E line of said Tract 6 a distance of 1216.40 feet to the true point of beginning; thence continuing S along the E line of said Tract 6 a distance of 259.74 feet to a point on the S line of said Cedar Hill Addition; thence E along said S line 366 feet; thence H parallel with ,-be E line of said Tract 6 Laguna Xesa Tracts 259.74 feet to a point; thence 1111 366 feet to the point of beginning. This grant is made subject to the follwhg CoVenants and conditions on the part of the second party, its successors and assigns, to be by them kept and performed, siz: 1st. That upon the permanent removal from said premises by the second party, its successors and assigns, of all of the above mentioned Items and equipment, the right to remove which is hereby granted, the surface of the ground shall be restored as nearly as possible to its present general condition. 2nd. That the placing construction, reconstruction, main- tenance, operating and repairing of any and all of said items and equipent shall be done so as to interfere as little as possible with the agricultural use and cultivation of the above described real property by the first party; that the surface grade of said party shall carry on their operations of said real property in such mannep as not to damage or interfere with any of the equipment at any time placed, constructed, maintained or used thereon by the second party, its successors and assigns.
