The Easterly 120.00 feet of Tract 3 of Laguna Mesa Tracts, in the City
Carlsbad, County of San Diego, State of California, according to Map No
1719, filed in the Office of the County Recorder of said County June 20
1921: ALSO, that portion of the Westerly half of Road Survey No. 135
adjoining said land on the East as vacated and closed to public use,
EXCEPTING from said Tract 3 and said Road Survey No. 135 that portion
described as follows:
Beginning at the most Southeasterly corner of said Tract 3 running then
North 0" 2' West along the Easterly boundary line of said Tract, which
also the Westerly boundary bine of Front Street (now known as Jefferson
Street), a distance of 600.00 feet to a point; thence South 25O 29' 50"
West, a distance of 329.05 feet to a paint; thence South 52" 34' 10'' WE
a distance of 102.00 feet to a point: thence South 28" 11' 30" West, a
distance of 141.22 feet to a point; thence South 23" 59' 40" West, a di
tance of 123.81 feet to a point on the Southerly boundary line of said
Tract 3; thence South 89" 30' 50" East along said Southerly boundary li
a distance of 340.35 feet to a Point of Beginning.
ALSO EXCEPTING from said Tract and said Road Survey that portion descri
as follows:
Beginning at the Southeasterly corner of said Tract 3; thence North 0"
West along the Easterly line of said Tract, 66.91 feet; thence North 85
30' 50" West 310.64 feet to a point in the Westerly line of the land cc
veyed to Einer V. Anderson and wife, by deed recorded July 17, 1926, as
Document No. 43679 in Book 1251, page 79 of Deeds, said point being the
TRUE POINT OF BEGINNING; thence continuing North 89" 30' 50" West 30.(

Records: thence along the Westerly line of said land North 18O 39' 59"

point in the arc of a 970.00 foot radius curve,concave Westerly in the

It is understood and agreed by the parties hereto that the easement herein described is granted as a pc
easement for the purpose of erecting. constructing, reconstructing, repIacing, repairing. maintaining, and operating
-drainagc,m excavation, and/or embankment facilities and appurtenances thereto, togetk
the right of ingress and egress to and from said right of way by practicaI route or routes in, upon, over. and acl
aforesaid Iands, together with the right to clear and keep clear said right of way from buildings, structures, tre
brush, and any simdar surface or subsurface encroachment which may interfere with reasonaLIe and proper use
right of way easement. The Grantor and successors in estate of the aforesaid lands hereby agree to neither permit n
or construct any building or structure, plant any tree, or othelwise create or permit any encroachment which may j
with reasonabIe and proper use of the said right of way easement by the Grantee.
