SAN DIEGO GAS & ELFCTRIC CONPipsjc, a corporation, hereinafter called the
"Grantor*', for a valuable consideration, does hereby grant to the CITY OF CARL
a nunici;?al corporation, in the County of San Diego, State of California, here
called the tfGranteett, an easement and right of way for public street and incih
thereto, through, over, under and across the Grantor's land situate in the Ci$
Carlsbad, County of San Diego, State of California, and more particularly desc
as follows :
That portion of Lot tlHt' of Rancho Agua Hedionda, according
to Partition Map thereof No. 823, filed in the office of the
County Recorder of San Diego County, November 16, 1896, described
in a Deed to Sa Diego Gas & Electric Company, a corporation,
dated SeptemSer 23, 1948, and recorded October 8, 1948, in Book 2974 at page 493 of Official Records of said County of San Diego,
excepting therefrom that certain portion thereof described in a
Deed recorded in Book 4722 at page 359 of said Official Records,
said easement and right of way being more particularly described
as follows:
Diego Gas & Electric Company's land, which said point is the most
Idesterly corner of Terramar Unit No. 3, according to the Map
thereof No. 2867, filed in the office of the County Recorder of
said County of San Diego; thence Nort'n 66" '54' 10" East, along
the Southeasterly line of said San Diego Gas & Electric Company's land, being also the Northwesterly line of said Terramar Unit
No. 3 and its Northeasterly prolongation, a distance of 417.84
feet to a point of intersection with the arc of a 2370.00 foot
radius curve, concave Southerly, a radial line of said curve,
passing through said point bears North 19" 01' 10" West, said
point of intersection being the TRUE POIKC OF, BEGLNNING; thence
leaving said Southeasterly line of said San Diego Gas Zt Electric
Compwts land, Westerly along the arc of said 2370.00 foot
radius curve, through a central angle of 4" 04% 40", a distance
of 168.67 feet; thence taagent to said last mentioned curve
South 66" 541 10" West, a distance of 6.58 feet to a point of
intersection with the arc of a 1340.82 foot radius curve, concave
Southerly, a radial line of said curve passing through said point
bears North 18O 39' 36s West; thence Easterly along the arc of
said 1340.82 foot radius curve, through a central angle of 02O 33' 53", a distance of 60.C2 feet to an intersection with said
Southeasterly line of said San Diego Gas & Electric Companyts
land; thence North 66" 54' 101' East, a distance of 115.41 feet
to the TRTJE POINT OF BZGGZNHING.
Beginning at a point in the Southeasterly line of said San

Grantee, its successors, assigns or agents shall be responsible for any d
to Grantor's existing facilities occasioned by or arising from the constructic
said public street within said Grantor's property and that the work in connect
the installation of said public street shall be done in a workmanlike manner.

Grantor reserves unto itself, its successors and assigns, the right to us
