Ingress and egress and right of way for construction and repair shall be through and along established access openings and routes of travel to and along said easement or along such other routes as designated by Grantor, his agents or assigns. 2. Grantee shall at all times indemnify and save harmless County against, and pay in full, all loss, damage or expense that County may sustain, incur or become liable for, resulting in any manner from the construction, mainten- ance, use, state of repair or presence of Grantee's facilities and all necessary and proper fixtures and equipment for use in connection therewith, including any such loss, damage or expense arising out of (a) loss of, or damage to, property (b) injury to, or death of, persons, excepting any loss, damage or expense, and claims for loss, damage or expense resulting in any manner from the negligent act or acts of the County, its contractors, officers , agents or empl oyees. 3. Grantor shall not erect, place or construct, nor permit to be erected, placed or constructed, any building or other structure; plant any tree; drill or dig any well , within the limits of easement and right-of-way. 4. Grantee shall have the right, but not the duty, to trim or remove trees and brush within, along or adjacent to said easement and right of way when- ever Grantee deems it necessary. the duty as owner to trim or remove trees and brush to prevent danger or hazard to property or persons.
