On motion of Supervisor Austin , seconded by
Supervisor Bird J the following re8ol;Ution is
adopted:
WHEREAS, by deed recorded in Book 264, Page 226 of Official
Records in the Office of the County Recorder of San Diego County
the County of San Diego acquired a drainage easement across a
portion of Tract 115 of the Town of Carlsbad, according to Map
No. 775 on file in the office of said County Recorder; and
WHEREAS, at the time the County acquired said easement the
territory crossed and affected said easement was unincorporated
territory of the County ef San Diego; and
WiIEREAS, subsequent to the acquisition of said easement by
$he County of San Diego the City of Carlsbad was incorporated; a
WHEREAS, the boundaries of said city included all of the
pDper'cJr subject to said drainage easement acquired by.the Count
as aforesaid; and
ll€G3REAS, all of the drainage system of which the aforesaid
easement is a part is now within -the incorporated limits of the
City of Carlsbad, NOW THEREFORE
BE IT RESOLVED AND DETERMINED that by virtue of the incorpc
tion of the City of Carlsbad all right, title and interest of tk
County of San Diego in and to the aforementioned drainage easemf
has been transferred by operation of law to the said City of
Carlsbad, a municipal corporation.
