EASEMENT
For vaIuabIe consideration, receipt whereof is hereby acknowIedged,

, the Grantor, does hereby grant to the City
of CarIsbad, the Grantee, a right of way easement. TEN feet ( 10 * ) in width,
in, upon. over, and across the foIIowing described lands, to wit:
That portion of Tract No. 237 of Thum Lands, in the City of Carlsbad,
County of San Diego, State of California, according to Map thereof
No, 1681, filed in the Office of the County Recorder of San Diego
County, December 3, 1915, described as follows:
Beginning at a concrete monument at the intersection of the center line of Chinquapin Avenue, with the center line of Adams Street; thence along
said center line of Adams Street, North 28' 39' West 405.73 feet to a
point; thence South 6l0 21' West 536.8 feet to a point; thence South
Avenue; thence along said last mentioned line North 61O 21' East 536.8
feet to the point of beginning.

The center line of said right of way easement in the aforesaid Iand is particuIarIy described as
foIIows:
Comencing at a point on the center line of Adams Street, distant
thereon North 28O 39' West 405.73 feet from its intersection of said
center line with the center line of Chinquapin Avenue, as said
Avenue and Street are shown on said Map No. 1681; thence South
61° 21' West 531.80 feet to the TRUE POINT OF BEGINNING of said
easement; thence South 28O 39' East 375.73 feet to a point on the
Northerly Right of Way line of said Chinquapin Avenue as shown
on said Map No. 1681, said point being the Southerly terminus
of said center line of said easement.

It is understood and agreed by the parties hereto that the easement herein described is granted as a peq
easement for the purpose of erecting, constructing, reconstructing, repIacing, repairing, maintaining, and operating
system, sewerage, drainage, power line, excavation, and/or embankment facikties and appurtenances thereto, together
the right of ingress and egress to and from said right oE way by practical route or routes in, upon, over, and acros
aforesaid Iands, together with the right to clear and keep dear said right of way from buildings, structures, trees
brush, and any similar surface or subsurface encroachment which may interfere with reasonabIe and proper use o
right of way easement. The Grantor and successors in estate of the aforesaid Iands hereby agree to neither permit nor
or construct any budding or structure, pIant any tree, or otherwise create or permit any encroachment which may int
with reasonable and proper use of the said right of way easement by the Grantee.
