KINMAN, hereinafter referred to as OWNER, without regard to number or gender. RECITALS: This agreement, executed in duplicate, a copy of which has been received by each party hereto, is made with reference to the following facts: A. OWNER has requested CITY, pursuant to Carlsbad City Ordinance No. 9050, Section 500, as amended, to split his certain real property, herein- after referred to as PROPERTY, located in the City of Carlsbad, County of San Diego, State of California, more particularly described as: That certain portion of the Northwest Rarter of Section 6, Township 12 South, Range 4 West, San Bernardino Base and Meridian, in the City of Carlsbad, County of San Diego, State of California, described as follows: Beginning at the Northwest corner of said Section 6; thence along the North line of said Section South 89O 59' East 1,099.55 feet to an inter- of Sunnyslope Tract according to Map thereof No. 486, filed in the section with the Northerly prolongation of the East line of Block 13 Office of the County Recorder of said County; thence along said pro- longation and said East line of Block 13 South Oo 02' 36" West (Record South Oo 55' East) 334.14 feet to the TRUE POINT OF BEGINNING; thence leaving said East line of said Block 13, South 89O 52' 11 " East 86.95 feet to a point in the Southwesterly Right-of-way line of the California State Highway X1-SD-2B being also the arc of a 5,910 foot North 64O 42' 58" East to said point; thence Southeasterly along the radius curve concave Southwesterly, a radial line of said curve bears arc of said curve and along said Right-of-way line, 169.83 feet through a central angle of lo 38' 47"; thence leaving said curve and said Right-of-way line North 89O 42' 20" West 36.20 feet; thence South 780 39' 36" West 36.57 feet; thence South 2O 32' 09" East 152.60 feet to a point in the North line of Knowles Street, 40 feet wide; thence along said North line North 89O 42' 20" West 92.20 feet to a point in said East line of said Block 13, of Sunnyslope feet to the TRUE POINT OF BEGINNING. OWNER agrees tojoinin and cooperate fully with any proposed improvement, improvement district, or other proceeding hereinafter instituted for the purpose of causing the installation of any or all of said improvements. C. OWNER agrees to install and pay for any and all of said listed improvements upon written notice so:to do from CITY. In the event OWNER fails to install and pay for said improvements when required to do so hereunder, CITY may cause said improvements to be in- stalled and OWNER shall pay the cost thereof to CITY. D. OWNER hereby grants to CITY a lien on property to secure the performance of each and all of his agreements hereunder. E.
