NOTICE OF RESTRICTION ON REAL PROPERTY
The real property located in the City of Carlsbad, County of San Diego, State of
California described as follows:
Lot 14 of Tierra del Oro, in the City of Carlsbad, County of San
Diego, State of California, according to Map thereof No 3052, filed
in the Office of the County Recorder of San Diego County,
February 4,1954
is restricted by a Coastal Development Permit and Administrative Variance No. CDP 04-
11 and AV 04-03 issued by the City of Carlsbad or! August 17, 2004. A copy is on file at
the City of Carlsbad Planning Department. The obligations and restrictions imposed are
binding on all present or future interest holders or estate holders of the property.
This Deed Restriction also serves to disclose the waiver of public liability as required by
Section 21.204.120 of the City's Zoning Ordinance.
The subject property owners and, and all future owners in interest, unconditionally
accept and agree to the following:

a) That the owners understand that the site may be subject to extraordinary hazard
from waves during storms, from erosion, and from landslides, and the owners
assume the liability from those hazards;
b) The owners unconditionally waive any claim of liability on the part of the
California Coastal Commission or the City of Carlsbad for any damage from such
hazards; and
c) The owners understand that construction in the face of these probable hazards
may make them ineligible for public disaster funds or loans for repair,
replacement, or rehabilitation of the property in the event of storms and/or
landslides.
