The subject property owners and, and all future owners in interest, unconditionally accept and agree to the following: a) That the owners understand that the site may be subject to extraordinary hazard from waves during storms, from erosion, and from landslides, and the owners assume the liability from those hazards; b) The owners unconditionally waive any claim of liability on the part of the California Coastal Commission or the City of Carlsbad for any damage from such hazards; and c) The owners understand that construction in the face of these probable hazards may make them ineligible for public disaster funds or loans for repair, replacement, or rehabilitation of the property in the event of storms and/or landslides. The obligations and restrictions imposed are binding on all present or future interest holders or estate holders of the property.
