Pursuant to Carlsbad Municipal Code Chapter 3.12 governing Transient Occupancy Taxes, the
undersigned City of Carlsbad (City) hereby declares that:
1. Russell Bennett, owner of the property located at 3114 Lincoln Street, Carlsbad, California,
described in Exhibit A, has failed to remit or pay the required Transient Occupancy Taxes
when due, and presently owes the City the sum of $10,843.48, said sum being due and
payable pursuant to Carlsbad Municipal Code chapter 3.12, as follows:
a. Delinquent Transient Occupancy Taxes: $7,855.50
b. Penalties: $1,571.10
c. Interest: $1,416.88
$10,843.48
2. The City has complied with all provisions of the Carlsbad Municipal Code chapter 3.12 in the
determination of the amount required to be remitted and paid.
3. From the time of filing for record, the amount required to be remitted together with
penalties and interest constitutes a lien upon all real property in the county owned by
Russell Bennett or afterwards acquired by him. The lien has the force, effect and priority of a
judgment lien and shall continue for ten years from the time of filing of the notice of lien
unless sooner released or otherwise discharged.
