NOTICE OF GRADING VIOLATION
The City Engineer has determined that the parcel of real property described below is in violation of the Carlsbad Municipal Code Chapter 11.06 Excavation and Grading.
VIOLATION: Specific violations of Chapter 11.06 are as follows:
1. CMC 11.06.30 . Grading was done without first having obtained a grading permit from the City Engineer.
2. CMC 11.06.030(5) . Excavation affects the lateral support or increases the stress in or pressure upon an adjacent or contiguous property.
3. CMC 11.06.030(8XA) . Fill exceeds three feet in vertical height.
4. CMC 11.06.030(8XB). Fill placed on an existing slope steeper than five units horizontal to one vertical.
5. CMC 11.06.030(8XC) . Fill changes or adversely affects the existing drainage pattern.
6. CMC 11.06.030(8XD). The toe of the fill is closer than three feet to an exterior property line.
7. CMC 11.06.030f8XE) . Grading exceeds one hundred cubic yards of material per each eight thousand square feet of area.
8. CMC 11.06.030 (9) . Grading poses a danger to private property.
PROPERTY DESCRIPTION: That certain parcel of land located in the City of Carlsbad, County of Sari Diego, State of California, being a portion of Lot 117 of Laguna Rivera Unit No. 4 Map[ No. 6529 filed in the office of the County Recorder of San Diego County on October 28, 1969 with an APN 207.250.15.
