For valuable consideration, receipt of which is hereby acknowledged,
the Carlsbad Unified School District, owner of the hereinafter described
property and hereinafter referred to as "Owner", hereby waives any and
all damages to the Owner's hereinafter described property by reason of the
discharge of water through or along a storm drain pipe onto the Owner's
propertv and hereby releases the City of Carlsbad from maintaining said
storm drain pipe where it extends onto Owner's hereinafter described pro-
n-W.
This waiver and release shall be binding on the Owner and the admin-
istrators, successors and assigns of the Owner and each of them.
The property of the Owner referred to above is situated in the City
x of Carlsbad, County of San Diego, State of California and is more parti-
cularly described as follows:
A portion of Tracts 246 and 247, Thum Lands, Hap 1681, San Diego County, California.
Assessor's Parcel No. 205-220-33, 207-010-21, 207-010-22, 207-010-23, 207-010-24
. - All as shown for convenience sake on Attachment "A", attached hereto
and made a part hereof.
