CLE F..- 1 ,\tLCROER c PETITION, WAIVER AND CONSENT TO SPECIAL ASSESSMENT PROCEEDINGS WHEREAS, the undersigned Developer at this time is processing 1 for development within the City a development project known and identified as [ CT 85-18 (hereinafter referred to as the aProject*); and, WHEREAS, in consideration for development, the Developer is responsible for the construction, installation and/or financing of the following described public improvements: widening of Hillside Drive west of Park Drive WHEREAS, in consideration of proceeding with development, Developer hereby petitions the City for the initiation of proceedings for the formation of a special assessment district, which will cause the construction and installation of certain improvements, including the above described improvements, and the undersigned hereby further understands the following: 1. That the costs of the improvements will be charged to the land which benefits from the improvements, including the land developed by the undersigned; expenses will be included within the project, 2. That the cost of engineering, legal, and other incidental The undersigned expressly waives the proceedings required and all limitations under the "Special Assessment Investigation, Limitation and Majority Protect Act of 1931*, being Division 4 of the Streets and Highways Code of the State of California. The undersigned hereby further consents to the proceedings and waives any right to protest to the formation of the Assessment District and the ordering of the improvements under applicable California special assessment statutes; however, Developer reserves the right to review the ! C; methodology and formula for the final distribution and spread 4 of the assessments. The property developed by the undersigned, which would be included within the boundarkes of the above-referenced Assessment District and assessed for its proportionate share of the costs and expenses, is as set forth in Exhibit "Aa, attached hereto, referenced and so incorporated. This Petition, Waiver and Conseint shall be binding on all heirs, successors and assigns o:n the above-described property. This petition is contingent upon recordation of final map.
