NOTICE IS HEREBY GIVEN that the Agreement for Payment of Public Facilities Fees
between Bank of America, Trustee of the Mary E. Bressi Trust a National Banking Association
as Owner, Aviara Land Associates Limited Partnership a Delaware limited partner as Developer,
and the City of Carlsbad, for outside the boundaries of Community Facilities District No. 1,
recorded on September 13, 1993, as Document No. 1993-0599398, is hereby released for the
following reason:
