AgreementtoPayIncreasedFeesforDevelopmentManagement System,datedFebruary21,1986-RecordertsFileNo.86-082699, CUP-258, PC-85-336, 160 Hotel Units TheseagreementsarearesultoftheCityts implementationof#eGrow& ManagementPlan. Allapplicationsthatweresubmittedsubsequenttothe adoptionoftheGrowthManagementPlanwererequiredtosignanagreement topayanyandallfuturefeesassociatedwiththeGrowthManagementPlan. Therearetwofeesthatarekeepingtheseagreementsfroanbeingreleased atthistime. First, isanidentifiedfee, whichisan increasefrom2.5to3.5' percentbasedonthepermitvaluationoftheconstructionthatocanredinthe recentadditionsWrenvsdelingofthefacility. Ihisonepercentwillbebilled withinthenextthirtydays. Thesecond fee,whichhasnotyetbeen detennined,isthe~ialandindustrialfairshareofexistingdeficiencies inthesouthCarlsbadarea. Ihesearecontingentliabilities associatedwithal. applicants/developerswhosignedagreementstopay~nyandallfuturef~. Theagreementwasamethodbywhichdevelopmentcouldoccurpriortothe establishmentof fees. Applicantswhochosenottosignthefuturefee agreements,wouldnotbeissuedanypermitsuntilallofthefeeswere establishedsotheycculdpaytheirfairsharetomitigatedeficienciesintheir ZoneorQuadrantoftheCity.
