AgreementtoPayIncreasedFees forDevelopmentManagement System, datedFebruary21,1986-Recorder'sFileNo. 86-082699, CUP-258, PC-85-336, 160 Hotel Units TheseagreementsarearesultoftheCity'simpl~entationoftheGrawth ManagementPlan. Allapplicationsthatweresubmittedsubsequenttothe adoptionoftheGrowthManagementPlanwererequiredto sign anagreement topayanyandallfuturefeesassociatedwiththeGrowthManagementPlan. Therearetwofeesthatarekeepingtheseagreementsfrombeingreleased atthistime. First, isanidentifiedfee, whichisan inczasefrom2.5to3.5' percentbasedonthepennitvaluationoftheconstructionthatoccurredinthe recentadditionsandremodelingofthefacility. Thisonepercentwillbebilled withinthenextthirtydays. Thesecond fee,whichhasnotyetbeen determined, isthe~ialandindustrialfairshareofexistingdeficiencies . inthesouthCarlsbada.rea. Thesearecontingentliabilitiesassoc iatedwithall applicants/developerswhosignedagreementstopayanyandallfuturefees. Theagreementwasamethodbywhichdevelopmentcouldoccurpriortothe establishmentoffees. Applicantswhochosenottosignthefuturefee agreements,wouldnotbeissuedanypermitsuntilallofthefeeswere establishedsotheycculdpaytheirfairsharetomitigatedeficiencies intheir ZoneorQuadrantoftheCity.
