Box 7974 Newport Beach, CA 92658 FILE SUBJECT: CD 2017-0026 (DEV2017-0192)-LA COSTA PLAZA ("'Cityof Carlstiad The City Planner has completed a review of your application for a Consistency Determination, CD 2017- 0026, which is a modification to SOP 97-07((), to add a 600 square foot outdoor dining area, including food and alcohol service, to the north elevation of a 4,50_Q square foot commercial building addressed as 7680 El Camino Real. The commercial building is identified as Building Don Parcel 4 within the La Costa Plaza shopping center, located on the northeast corner of La Costa Avenue and El Camino Real (APN 216- 580-04). As a result of the addition of the outdoor dining area, one additional parking space is required. Including the proposed outdoor dining area, a total of 402 parking spaces are required in the shopping center and a total of 411 spaces exist. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1} No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the additional outdoor dining area is a complementary use to the shopping center and adequate parking exists. 2} The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood. 3} The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in-that outdoor dining is an accessory use to the shopping center. 5) The proposed revision does not rearrange the major land uses within the development. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that no additional building area is proposed and adequate parking is provided to accommodate the additional outdoor dining area. 7} The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the outdoor dining area is proposed in an area that is developed with hardscape. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved.
