HomeMy WebLinkAboutCD 2018-0023; LA COSTA SQUARE BUILDING 5 THEATER; Admin Decision LetterOctober 17, 2018 Scott Grady TRC Retail 4695 Macarthur Court, Suite 700 Newport Beach, CA 92660 ~ I 6 /j i /t<( ~ 8FILE COPY i ( City of ~t Carlsbad SUBJECT: CD 2018-0023 (DEV01024)-LA COSTA TOWN SQUARE BUILDING 5 THEATER The City Planner has completed a review of your application for Consistency Determination, CD 2018- 0023 -LCTS THEATER, BLD. 5 (APN: 223-053-05-00) which is a modification to Site Development Plan Amendment (AMEND) 2017-0003 to SDP 01-04{A) and Conditional Use Permit (CUP} 2017-0002, that approved construction and operation of a 33,500-square-foot, 850 seat movie theater, and a 6.7 percent parking reduction for Building Pad 5 within the La Costa Town Square shopping center on a 1.82-acre lot located at 3434 Via Mercato. After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • Reduction in height of the theater from 50'-4" to 48'; • Reduction in the number of seating from 850 to 569; • Revision of exterior building materials; and • Adjustment of parking reduction from 6.7 percent to 2.7 percent, subsequently reducing the overall parking reduction from the maximum 15 percent to 11 percent. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood the reduction in height of the movie theater reduces the size and scale of the building, making it more compatible with the existing surrounding structures. The revisions to the exterior building materials modernize the building, yet still complement the existing architecture and design of the shopping center. 3} The proposed revision does not change the density or boundary of the subject property. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit in that there are no proposed land use changes. 5) The proposed revision does not rearrange the major land uses within the development. 6} The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code In that the modifications are not greater than ten percent of the original approval and comply with all applicable development standards. Community & Economic Development Planning Division j 1635 Faraday Avenue Carlsbad, CA 92008-7314 j 760-602-4600 I 760-602-8560 f I www.carlsbadca.gov CD 2018-0023 (DEV01024)-LA COSTA TOWN SQUARE BUILDING 5 THEATER October 17, 2018 ., , , --, !'"""'! . i . j Pa e 2 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation in that the reduction in height, seats and parking spaces and revision of exterior building materials, do not create any significant environmental impact. 8) The proposed change would not result in any health, safety or welfare impacts in that the reduction in height, seats and parking spaces and revision of exterior building materials, will meet all civil, structural and building code requirements. 9} There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change In that the reduction in height, seats and parking spaces and revision of exterior building materials, reduce any potential controversy associated with the original approval. 10} The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35. Please note that the proposed revisions may necessitate issuances of a grading permit, building permit and approval of final landscape plans. Approval of this request shall not excuse compliance with all applicant sections of the Zoning Ordinance, and all other applicant City ordinances.
