HomeMy WebLinkAboutCD 2018-0024; SDG&E STEEL POLE WCF; Admin Decision LetterFebruary 4, 2019 Mark Phillips 2014 Granada Avenue San Diego, CA 92104 SUBJECT: CD 2018-0024 (DEV06108) -SDG&E STEEL POLE WCF Ccicyof Carlsbad The City Planner has completed a review of your application for Consistency Determination CD 2018-0024 (APN: 215-052-13), which is a modification to CUP 06-20 to upgrade the existing unmanned wireless communications facility (WCF). After careful consideration of the request, the City Planner has determined that the request meets all of the findings below and APPROVES this request. The proposed modifications include: • Removal of three 72-inch panel antennas and replacement with three new 72-inch panel antennas and three new 42-inch panel antennas on the existing pole. • Relocation of three existing RRH units and installation of six new units to be stacked behind proposed panel antennas. • Installation of 660 linear feet of cable in existing conduits. • Installation of one new equipment cabinet and one new junction box within the existing equipment shelter. For a Discretionary Permit Consistency Determination. to be approved, all af the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the proposed modification will not change the height of the existing pole or the size of the existing equipment shelter. 2) The request represents an upgrade in overall design features and ar materials and improves upan the project's compatibility with the surrounding neighborhood in that the proposed antennas will be painted to match the color of the transmission pole and the proposed cabinet will be installed within the existing equipment shelter. 3} The proposed revision does not change the density or boundary of the subject property function in that all aspects of the property remain as previously approved. 4) The proposed revision does not involve the addition of a new land use not shown on the original permit. 5) The proposed revision does not rearrange the major land uses within the development. CA 92008-7314 I 760-602-4600 I 760-602-8560 f I www.carlsbadca.gov ----·----·--------------- CD 2018-0024 (DEV06108)-SPRINT SWALLOW LANE February 4, 2019 Pa e 2 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the proposed modifications to the existing WCF qualify as an eligible facility modification pursuant to Section 6409(a) of the Middle Class Tax Relief and lob Creation Act of 2012 (47 U.S.C. § 14SS(a)). 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation In that the proposed project is in substantial conformance with CUP 06-20, which determined that the project is categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15303 -New Construction or Conversion of Small Structures of CEQA Guidelines. BJ The proposed change would not result in any health, safety or welfare impacts in that the applicant submitted a Radio Frequency -Electromagnetic Energy Compliance Report which, through predictive worst-case modeling, concludes that the proposed modification complies with FCC rules and regulations. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change in that the original approval addressed neighbors' concerns with the equipment shelter. The equipment shelter will not change with the proposed modification. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved In that the proposed modification does not change the use of the site or existing structures. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Division Administrative Policy No. 35.
