HomeMy WebLinkAboutCD 2019-0024; CARLSBAD OAKS NORTH LOT 24; Admin Decision LetterDecember 30, 2019 Oliver Castilleja Millipore Sigma 6211 El Camino Real Carlsbad, CA 92010 ~ \.Q.QJ l'2. · 3 \ · \ °) 8FILE COPY SUBJECT: CD 2019-0024 (DEV2016-0032) -CARLSBAD OAKS NORTH LOT 24 Dear Mr. Castilleja, ("Cityof Carlsbad The City Planner has completed a review of your application for Consistency Determination, CD 2019- 0024, which is a modification to Minor Site Development Plan SDP 2016-0001, which allowed for the development of an industrial shell building totaling 144,742 square feet at 2827 Whiptail Loop East (APN 209-120-26-00), located within the Carlsbad Oaks North Specific Plan area. After careful consideration of the request, the City Planner has determined that the request meets all the findings below and APPROVES this request. The proposed modifications include: • Removal of 21 parking spaces (from 368 spaces existing) and 1,401 square feet of parking lot landscaping (from 35,188 square feet existing) within a portion of the existing parking lot located to the rear of the property and adjacent to the existing building; and • The addition of a mechanical equipment yard (approximately 5,883 square feet) surrounded by a new 15-foot-tall screen wall. The bottom portion of the screen wall consists of a 6-foot-tall solid masonry wall finished to match the building and is topped with a combination 9-foot-tall metal louvered fence and a 9-foot-tall metal wire mesh fence with climbing vines. In order for a Discretionary Permit Consistency Determination to be approved, all of the following findings must be made: 1) No project condition, feature, facility or amenity is changed or deleted that had been considered essential to the project's design, quality, safety or function in that the removal of the 21 parking spaces will not reduce parking levels below that which is required for the proposed use (Required: 319 spaces, Provided: 347 spaces); and the removal of 1,401 square feet of parking lot landscaping from a total of 35,188 square feet of parking lot landscaping provided onsite will not be reduced below the 16,394 square feet required per the original Minor Site Development Plan, application no. SDP 2016-0001. 2) The request represents an upgrade in overall design features and or materials and improves upon the project's compatibility with the surrounding neighborhood in that the proposed screen wall utilizes building materials currently exhibited within the existing building elevations or that are architecturally compatible and will adequately screen the proposed equipment. 3) The proposed revision does not change the density or boundary of the subject property. SDP 2016-0001, or anticipated within the Planned-Industrial (P-M) Zone. 6) The proposed revision does not create changes of greater than ten percent provided that compliance will be maintained with the applicable development standards of the Carlsbad Municipal Code in that the reduction of 21 parking spaces equals a 6% change, and the elimination of 1,401 square feet of parking Jot landscape equals a 4% change. 7) The proposed change will not result in any significant environmental impact, and/or require additional mitigation~ in that the proposed improvements do not create any inconsistencies or new impacts relative to the environmental review process associated with the original project's approval. 8) The proposed change would not result in any health, safety or welfare impacts. 9) There were not any major issues or controversies associated with the original project which would be exacerbated with the proposed change, in that the proposed equipment yard with screen wall maintains the general design, quality and function of the original project. 10) The proposed change would not be readily discernable to the decision makers as being substantially different from the project as originally approved, in that the proposed equipment yard with screen wall utilizes building materials for the enclosure that maintain the general design, quality and function of the original project. Therefore, the City Planner has determined that the application qualifies for a consistency determination with the approved permit and approves the changes to the project based on Planning Divisiol'.l Administrative Policy No. 35.
