The project consists of an existing wireless communication faalrty (WCF) originally approved on Apnl 2, 2003 (CUP 02-18, Planning Commission Resolution No. 5383). The first extension for CUP 02-18X1 was approved by Planning Commission Resolution No. 6623 on August 19, 2009 which was set to expire on April 1, 2018. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the project is still in compliance with the Conditional Use Permit (CUP) regulations in Carlsbad Municipal Code (CMC) Chapter 2142 and Wireless Communication Policy 64, and (2) the findings required for granting a Minor Conditional Use Permit extension can be made, therefore, the city planner APPROVES the second extension to Conditional Use Permit CUP 02-18X1 for ten (10) years based on the following findings and conditions Findings: The permit or approval remains consistent with the general plan, all titles of the code and growth management program policies and standards in place are the time the extension was considered, and the findings contained in the Planning Commission Resolution No. 6623 apply to this extension and are incorporated herein by reference and remain in effect Circumstances have not substantially changed since the approval was originally granted as the wireless communication facility Is existing and no changes have been proposed The city planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categoncally exempt from the requirement for the preparation of environmental documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines In making this determination, the city planner has found that the exceptions listed in Section 15300 2 of the state CEQA Guidelines do not apply to this project Community & Economic Deveiopment Planning Dn/ision 1 1635 Faraday Avenue Carlsbad, CA 92008-73141760-602-46001 760-602-8560f | vwvwcarlsh)adca gov CUP 02-18X1 (DEV02059)-TAMARACK VERIZON May 11, 2018 Page 2 Conditions: 1 This Minor Conditional Use Permit extension is granted for a period often (10) years retroactively from Apnl 1, 2018, to Apnl 1, 2028, or until the facility is removed, whichever occurs first. 2 The conditions contained in Planning Commission Resolution No. 6623 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 4, which Is superseded by Condition No. 1 of this approval letter CITY OF CARLSBAD TERI DELCAMP Pnncipal Planner TDGRjb c Marja Dawn Selna, 6284 Forester Drive, Huntington Beach, CA 92648 Brenda Williamson, Verizon Wireless, BIdg D-1,15505 Sand Canyon Avenue, Irvine, CA 92618 Data Entry File Copy cHPRiyb
