HomeMy WebLinkAboutCUP 15-08; BUENA OUTFALL FORCE MAIN PHASE III; Admin Decision LetterFebruary 14, 2018 Buena Sanitation District Alfred Pedroza Senior Engineer 200 Civic Center Drive Vista, CA 92084 IMAGED Ff'~ 15 2018 CITY OF CARLSBAD vJI,, SUBJECT: CDP 14~06/CUP 15-~08 (DEV14020}-BUENA OUTFALL FORCE MAIN PHASE Ill -1st EXTENSION The Planning Division has completed a review of your application for the 1st extension of Coastal Development Permit and Conditional Use Permit, CDP 14-006 and CUP 15-008-BUENA OUTFALL FORCE MAIN PHASE Ill, located on property generally located within the public rights-of-way at the northeast corner of the intersection of Palomar Airport Road and El Camino Real, traversing within the westbound lanes of Palomar Airport Road, and continuing south on Paseo del Norte for approximately 1,200 feet. The project was approved on March 16, 2016 and is due to expire on March 16, 2018. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Coastal Development Permit and Conditional Use Permit regulations, and (3) that the findings required for granting a Coastal Development Permit and Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the 1st extension of Coastal Development Permit and Conditional Use Permit Nos. CDP 14-006 and CDP 15-008 for two (2) years (from March 16, 2018 to March 16, 2020), based on the following findings and conditions. Findings: 1. All of the findings contained in the Planning Commission Resolution Nos. 7148 and 7149, dated March 16, 2016, for CDP 14-006 and CUP 15-008 apply to this 1st extension and are incorporated herein by reference and remain in effect. 2. That the two (2)-year extension (from March 16, 2018 to March 16, 2020} is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the Coastal Development Permit and Conditional Use Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for the construction of a sewer pipeline and appurtenances (CDP 14-006 and CUP 15- 008}. 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. The Planning Commission, at its March 16, 2016 meeting, reviewed, analyzed and considered the MND and Addendum and determined thatthe MND prepared and adopted by the Buena Sanitation District at its September 24, 2014 Board meeting (Resolution No. 2014-20) had been prepared in accordance with requirements of CEQA and that there was no substantial evidence the project will have a significant effect on the environment and determined that the MND is adequate for use by the City of Carlsbad as a responsible agency. No changes to the project have occurred since the MND was adopted, therefore, the environmental document is still adequate. Conditions: 1. This 1st extension of the Coastal Development Permit and Conditional Use Permit is granted from March 16, 2018 to March 16, 2020. If building permits for this project are not obtained within this time period, the Coastal Development Permit and Conditional Use Permit extension will expire on March 16, 2020, unless extended per Section 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution Nos. 7148 and 7149, dated Mai:ch 16, 2016, for CDP 14-006 and CUP 15-008 apply to this 1st extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 12 in Planning Commission Resolution No. 7149, which is superseded by Condition No. 1 of this approval letter.
