Thank you for submitting an Early Assessment to: 1) reconfigure Kelly Drive to create a complete street
with buffered bike lanes, enhanced sidewalks, bulb outs, protected trails and new intersections at Hillside
Drive and Park Drive; and 2) reconfigure Park Drive to include a buffered bike lane and parking along the
north side and a bike lane and multiuse trail along the south/lagoon side of the public right-of-way.
In response to your application, the Planning Division has prepared this comment letter. Please note that
the purpose of an Early Assessment is to provide you with direction and comments on the overall concept
of your project. This Early Assessment does not represent an in-depth analysis of your project. It is
intended to give you feedback on critical issues based upon the information provided in your submittal.
This review is based upon the plans, policies, and standards in effect as of the date of this review. Please
be aware that at the time of a formal application submittal, new plans, policies, and standards may be
in effect and additional issues of concern may be raised through a more specific and detailed review.
Planning:
General
1. The project is located in the Mello II segment of the city's Local Coastal Program and will require
a Coastal Development Permit (CDP) issued by the city.
2. The proposed pedestrian trail on Park Drive appears to be located in the California Department
of Fish & Wildlife's (CDF&W) Preserve, a Proposed and Hardline Conservation Area, as defined in
the City of Carlsbad Habitat Management Plan (HMP), dated November 2004. Impacts to wetlands
and other sensitive habitat should be avoided or minimized as much as possible. If impacts are
unavoidable, a HMP Permit will be necessary and mitigated in accordance with HMP and Coastal
Zone requirements. Impacts to HMP habitats will be mitigated at the ratio shown on Table 11,
page D-113 of the HMP.
In addition, the project must comply with the Adjacency Standards listed in HMP Section F (3)
which addresses development on sites that are adjacent to wildlife preserves. The adjacency
standards are intended to prevent negative effects on wildlife preserves and must be addressed
in the planning of any development/habitat interface. The adjacency standards include the

following categories: Fire Mirnagement (A), Erosion Control (B), Landscaping Restrictions (C),
Fencing, Signs and Lighting (D); and'Pre.dator and Exotic Species Control (E). Please address how
the proposed project;inch.iding the construction phase, will be consistent with the HMP adjacency
standard section during submittal of the CDP application. For example, a Landscape Management
Plan should be prepared to insure that no invasive, exotic, or nonnative species will encroach into
the Veterans' Park Preserve. See pages F-16 through F-22 of the City's HMP for more information
on adjacency standards.
Further, if impacts are proposed within the Proposed and Hardline Conservation Area, a HMP
amendment will be necessary as well. The project may qualify for a minor amendment as an
"essential public works project" (pursuant to Zoning Ordinance Section 21.210.080 A.3.), if the
project meets the applicable requirements, and subject to concurrence by the resource agencies.
3. Environmental review for compliance with the California Environmental Quality Act (CEQA) will
need to be performed prior to construction. Based on the location of the project potentially
within and adjacent to ESHA, and the Agua Hedionda Lagoon, an Initial Study/Mitigated Negative
Declaration (MND) should be completed to comply with CEQA. Furthermore, a Jurisdictional
Delineation Report will need to be prepared for the project. Please review the Guidelines for
Biological Studies available on the city's website. Please submit the BTR, Cultural Resources
Report and Jurisdictional Delineation Report for planning staff review.
4. Complete and submit to the Planning Division a Traffic Analysis Report to determine the Level of
Service (LOS) on Park Avenue and Kelly Drive after the road diet and traffic calming elements are
installed to determin if Mobility Element Policy 3-P.15 of the General Plan is applicable to this
project.
