Jo Ann Stoddard 2851 Camino Del Rio South, Suite 200 San Diego, CA 92108 8FILE COPY ~ 7/IZ/18 Ccicyof Carlsbad SUBJECT: First Extension to MCUP 08-07 (DEV02061) -VERIZON PACIFIC CENTER ONE The Planning Division has completed a review of your application for the first extension to Minor Conditional Use Permit MCUP 08-07 -VERIZON PACIFIC CENTER ONE, located at 701 Palomar Airport Rd. The application was submitted on June 12, 2018, prior to the expiration date (June 16, 2018). The project consists of an existing wireless communication facility (WCF) originally approved on November 6, 1996 (CUP 96-09, Planning Commission Resolution No. 4006) and a subsequent extension approved on June 18, 2003 (CUP 03-02, Planning Commission Resolution No. 5418). The Conditional Use Permit was converted to a Minor Conditional Use Permit (MCUP 08-07) on June 18, 2008. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code (CMC) Chapter 21.42 and Wireless Communication Policy 64, and (2) the findings required for granting a Minor Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the first extension to Minor Conditional Use Permit MCUP 08-07 for ten (10) years based on the following findings and conditions. Findings: 1. The permit or approval remains consistent with the General Plan, all titles of the code and growth management program policies and standards in place are the time the extension was considered, and the findings contained in the Planning Director approval letter dated June 18, 2008, for MCUP 08-07-VERIZON PACIFIC CENTER ONE apply to this extension and are incorporated herein by reference and remain in effect. 2. Circumstances have not substantially changed since the approval was originally granted as the wireless communication facility is existing and no changes have been proposed. 3. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. This Minor Conditional Use Permit extension is granted for a period of ten (10) years retroactively from June 16, 2018, to June 16, 2028. 2. The conditions contained in Planning Director's approval letter dated June 18, 2008 for MCUP 08-07 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 8, which is superseded by Condition No. 1 of this approval letter.
