HomeMy WebLinkAboutMCUP 08-14; T-MOBILE LA COSTA PLAZA - 1ST EXTENSION; Admin Decision LetterOctober 23, 2018 Lauren Richards SACW 5015 Shoreham Place San Diego, CA 92122-5926 { City of Carlsbad SUBJECT: First Extension to MCUP 08-14 (DEV03035) -T-MOBILE LA COSTA PLAZA The Planning Division has completed a review of your application for the first extension to Minor Conditional Use Permit MCUP 08-14-T-MOBILE LA COSTA PLAZA, located at 7760 Rancho Santa Fe Rd. The application was submitted on August 18, 2018, prior to the expiration date (September 16, 2018). The project consists of an existing wireless communication facility (WCF) originally approved on September 17, 2003 (CUP 03-11, Planning Commission Resolution No. 5458). The original Conditional Use Permit was converted to a Minor Conditional Use Permit (MCUP 08-14) on October 28, 2008. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code (CMC) Chapter 21.42 and Wireless Communication Policy 64, and (2) the findings required for granting a Minor Conditional Use Permit extension can be made; therefore, the City Planner APPROVES the first extension to Minor Conditional Use Permit MCUP 08-14 for ten (10) years based on the following findings and conditions. Findings: 1. The permit or approval remains consistent with the general plan, all titles of the code and growth management program policies and standards in place are the time the extension was considered, and all of the findings contained in the City Planner approval letter dated October 28, 2008, for MCUP 08-14-T-MOBILE LA COSTA PLAZA apply to this extension and are incorporated herein by reference and remain in effect. 2. Circumstances have not substantially changed since the approval was originally granted as the wireless communication facility is existing and no changes have been proposed. 3. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Section 15301 -Existing Facilities, of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Conditions: 1. This Minor Conditional Use Permit extension is granted for a period of ten (10) years retroactively from September 16, 2018 to September 16, 2028. All of the conditions contained in Planning Director's approval letter dated October 28, 2008 for MCUP 08-14 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 9 which is superseded by Condition No. 1 of this approval letter.
