IP /1 /z o SUBJECT: MCUP 10-15 (DEV02099)-SD07644 BANK OF AMERICA-15r EXTENSION The Planning Division has completed a review of your application for the first extension of Minor Conditional Use Permit MCUP 10-15 -SD07644 BANK OF AMERICA, an existing wireless communications facility (WCF) located at 7700 El Camino Real. The application was submitted on July 13, 2020, prior to the expiration date. The WCF consists of five (5) wall-mounted panel antennas and associated equipment located inside the Bank of America building. The WCF was originally approved on March 5, 2003 (CUP 02-29, Planning Commission Resolution No. 5371). The original Conditional Use Permit was converted to a Minor Conditional Use Permit (MCUP 10-15) on July 27, 2010. MCUP 10-15 was set to expire on July 27, 2020. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the project is still in compliance with the Conditional Use Permit regulations in Carlsbad Municipal Code (CMC) Chapter 21.42 and Wireless Communication Policy 64, and (2) the findings required for granting a Minor Conditional Use Permit extension can be made; therefore, the City Planner retroactively APPROVES the first extension of Minor Conditional Use Permit MCUP 10-15 for ten (10) years from July 27, 2020 to July 27, 2030, based on the following findings and conditions. Findings: 1. The permit or approval remains consistent with the general plan, all titles of the code and growth management program policies and standards in place are the time the extension was considered, and the findings contained in the City Planner approval letter dated July 27, 2010 for MCUP 10- 15 -5D07644 BANK OF AMERICA apply to this extension and are incorporated herein by reference and remain in effect. 2. That the first extension of Minor Conditional Use Permit MCUP 10-15 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code and growth management program policies and standards in place at this time. 3. Circumstances have not substantially changed since the approval was originally granted as the wireless communication facility is existing and no substantial changes have been proposed. The City Planner has determined that the project belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental . documents pursuant to Section 15301-Existing Facilities of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Conditions: 1. This Minor Conditional Use Permit extension is gra"!ted for a period of ten (10) years from July 27, 2020 to July 27, 2030. 2. The conditions contained in the City Planner's approval letter dated July 27, 2010, for MCUP 10- 15 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 10, which is superseded by Condition No. 1 of this approval letter.
