The project site is an approximately 10,585-square-foot lot that is currently developed with a two-story, 12,763-square-foot building used for medical offices, above a basement parking garage. In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. This preliminary review does not represent an In-depth analysis of your project. It is intended to give you feedback on critical issues based upon the Information provided In your submittal. This review is based upon the plans. policies, and standards In effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans. policies. and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. General Plan and zoning designations for the property are as follows: a. General Plan: Village-Barrio (V·B) b. Zoning: Village-Barrio (V·B) Zone c. Village & Barrio Master Plan; Village Center (VC} Land Use District 2. The project site is not located within the Coastal Zone. 3. The project site is located within the Village Center (VC} District of the Carlsbad Village and Barrio Master Plan (VBMP). The project requires the following permits: a. Nonconforming Construction Permit (NCP). Pursuant to Table 2-1 of the VBMP, medical offices within the Village Center are a permitted. use, but not on ground floor street frontage within this area per Figure 2-2 of the VBMP. Also, the building does not meet VBMP setback and parking standards. Since this use has been in operation since the 1980's which is prior to implementation of the VBMP, the proposed project is subject to the provisions of the Nonconforming structures and uses provisions within Carlsbad Municipal Code Chapter 21.48. Given the scope of work includes exterior alterations, no expansion of interior floor area, and no increase in the intensity of uses that would require additional parking, no other planning applications are required. The NCP shall be processed administratively. 5. Village Center (VC) Supplemental District Standards. The project is subject to the VC Supplemental District Standards beginning on p. 2-36 within Section 2.7.1 of the VBMP. The following should be addressed in a formal submittal: a. Setbacks. The front/corner yard setbacks are a minimum ofO feet and a maximum offive feet. Please identify the setback of the unenclosed staircase from the property lines. Additionally, identify the right-of-way and the street to clearly show dimensions and proximity to the existing infrastructure on Jefferson Street. 6. Basement. At formal submittal provide cross-sectional-plans of the parking garage and the existing grade. In addition, explain how the parking garage meets the standard of a basement pursuant to CMC Section 21.4.045 "Basement means that portion of a building between floor and ceiling which is completely or partially below the existing grade or finished grade, whichever is lower, but so located that the vertical distance from exterior grade to the adjacent interior floor below is greater than the vertical distance from exterior grade to the adjacent interior ceiling above. This definition must apply to a minimum of seventy-five percent of the perimeter of the basement for that portion of a building to qualify as a basement."
