The project site, an approximately 6,252-square-foot lot, currently is developed with a three-story, three-unit condominium project. In response to your application, the Planning Division has prepared this comment letter. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. This preliminary review does not represent an in-depth analysis of your project. It is intended to give you feedback on critical issues based upon the information provided in your submittal. This review is based upon the plans, policies, and standards in effect as of the date of this review. Please be aware that at the time of a formal application submittal, new plans, policies, and standards may be in effect and additional issues of concern may be raised through a more specific and detailed review. Planning: General 1. General Plan and zoning designations for the property are as follows: a. General Plan: R-23 Residential, 15-23 units/ac. Growth Management Control Point of 19 units/ac b. Zoning: Multiple-Family Residential (R-3), Beach Area Overlay :Zone (BAOZ) c. The property is in the Coastal Zone. The Coastal land use designation and zone are the same as the general plan and zoning above. 2. The project re'quires the following permits: a. Coastal Development Permit b. Nonconforming Construction Permit The project is not exempt from a Coastal Development Permit for improvements to an existing residential structure since the project site is located within 300 feet of the coastal bluff. The city has permit authority in this area. However, the project is located within the appeal jurisdiction of the Coastal Commission. If the construction building valuation is greater than $60,000, a regular CDP will be required to be approved by the Planning Commission. A Nonconforming Construction Permit (NCP) is required due to the existing nonconforming building height and · possibly nonconforming side-yard setbacks. The NCP will be processed concurrently with the CDP and acted on by the same decision-making body as the CDP. 3. New requirements related to the city's Climate Action Plan (CAP) may impact development requirements of this project. A formal application submittal will need to include a completed CAP Checklist (Form P-30) to determine what requirements will apply to the project. New CAP requirements are related to energy efficiency, photovoltaic, electric vehicle charging, water heating and traffic demand management requirements, as set forth in City Council Ordinance Nos. CS-347, CS-348, CS-349 and CS-350 and City Council Resolution No. 2019-024 which are available on the city's website at the following address: http://www.carlsbadca.gov/services/depts/pw/environment/cap/ordinances.asp. To the extent that some or all of the new CAP requirements are in effect at the time of application for grading or building permits, the project will be required to comply with the effective requirements even if different than what is proposed in the project's planning approvals. CAP requirements may impact, but are not limited to, site design and local building code requirements. Once adopted as part of Title 18 and in effect, plans submitted for grading or building permits must demonstrate compliance with the new CAP requirements. If incorporating new CAP requirements results in substantial modifications to the project after planning approvals are obtained, then prior to issuance of grading or building permits, the applicant may be required to submit and receive approval of a Consistency Determination or an Amendment application for the project through the Planning Division. 4. The maximum building height in the Beach Area Overlay Zone (BAOZ) is 30 feet for roofs with a minimum 3:12 roof pitch or 24 feet for flat roofs or less than 3:12 roof pitch. Any new addition must comply with these building heights. However, per .Carlsbad Municipal Code (CMC) Section 21.46.020, roof structures specifically for the housing of elevators, stairways, parapet walls, architectural features or towers, may be erected above the height limit but shall not be allowed for the purpose of providing additional floor space, or be taller than the minimum height required to accommodate or enclose the intended use. Therefore, the proposed stair and elevator tower may be allowed above the 30-foot height limit if designed to meet the requirements of CMC Section 21.46.020. 5. The proposed rear deck and balcony modifications must comply with the 24-foot maximum building height and all required setbacks. Please clearly show the height of all existing and proposed structures as measured from the existing or finished grade, whichever is lower. 6. Required safety railings around balconies and decks may exceed the maximum building height of the zone provided that the railing/barrier height is the minimum necessary to meet the Building Code requirements in place at the time of building permit issuance (currently 42 inches). Please review all information carefully before submitting. Land Development Engineering: 1. Complete a Stormwater Standards Questionnaire. This questionnaire will guide you and the city in determining what type of reports and storm water mitigation must be completed to satisfy state and city storm water quality requirements. The questionnaire can be printed from the following website link: http:ljwww.carlsbadca.gov/civicax/filebank/blobdload.aspx?Blob1D=22711 Preliminary analysis suggests that the project is a Standard Project and subject to installing site design and source control BMPs per Chapter 4 of the Carlsbad BMP Design Manual and per the Standard Project Requirement Checklist (E36) that will also need to be completed. Plot proposed drainage and existing and finish surface elevations around the addition in the front of the building. 3. Provide grading quantities, including any required excavation and re-compaction (remedial grading) of soil for the foundation of stairs and elevator addition, regardless of how small the grading quantities are. A grading permit will likely not be required but this information will help confirm whether a permit is required or not. . Building: 1. The city will be adopting the 2019 California Building Code (CBC) which will become effective on January 1, 2020. The project must comply with these regulations.
