The project, located on a previously graded development pad on the south side of Palomar Airport Road between Hidden Valley Road and Aviara Parkway in the Mello II segment of the Coastal Zone, was approved on July 6, 2016, and due to expire on July 6, 2018. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the first extension of Minor Site Development Plan (SDP 15-23} and Coastal Development Permit (CDP 15-43} -NORTH COAST MEDICAL PLAZA was submitted in a timely manner prior to the expiration date, (2) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (3) the project is still in compliance with the Coastal Development Permit regulations, and (4) that the findings required for granting a Minor Site Development Plan and Coastal Development Permit extension can be made; therefore, the City Planner retroactively APPROVES the first extension of Minor Site Development Plan (SDP 15-23} and Coastal Development Permit (CDP 15- 43} -NORTH COAST MEDICAL PLAZA for two (2) years from July 6, 2018, to July 6, 2020, based on the following findings and conditions. Findings: 1. All the findings contained in the Planning Commission Resolution No. 7178 dated July 6, 2018, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the first two-year extension from July 6, 2018, to July 6, 2020 is appropriate because the owner/applicant is dilfgently pursuing finalizing all necessary permits, the project is still consistent with the Site Development Plan and Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for construction of a 49,942 square-foot, three-story medical office shell building (SDP 15-23/CDP 15-43). 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. The City Planner has determined that: a. the project is a project for which a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program were previously adopted [15162] (City Council Resolution No. 2013-228, dated September 13, 2013}; b. this project is consistent with the·project cited above; c. the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program were adopted in connection with the prior project; d. the project has no new significant environmental effect not analyzed as significant in the prior Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program; e. none of the circumstances requiring further environmental compliance under CEQA Guidelines Sections 15162 or 15163 exist; and f. the City Planner finds that all feasible mitigation measures identified in the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, which are appropriate to this Subsequent Project, have been incorporated into this Subsequent Project. Conditions: 1. This first extension of the Minor Site Development Plan and Coastal Development Permit is granted from July 6, 2018 to July 6, 2020. If building permits for this project are not obtained within this time period, the Minor Site Development Plan and Coastal Development Permit will expire on July 6, 2020, unless extended per Sections 21.58.040 and 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution No. 7178 dated July 6, 2016, for SDP 15-23 and CDP 15-43 apply to this extension and are incorporated herein by reference and remain in effect except for Condition No. 9, which is superseded by Condition No. 1 of this approval letter, and Condition No. 32, which is deleted.
