The project, located on a previously-graded development pad on the south side of Palomar Airport Road between Hidden Valley Road and Aviara Parkway in the Mello II segment of the Coastal Zone, was approved on July 6, 2016, and due to expire on July 6, 2018. On July 23, 2018, the City Planner retroactively granted the first two-year extension of SOP 15-23 and CDP 15- 43 from July 6, 2018, to July 6, 2020. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the second extension of Minor Site Development Plan (SOP 15-23) ·and Coastal Development Permit (CDP 15-43) -NORTH COAST MEDICAL PLAZA was submitted in a timely manner prior to the expiration date, (2) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (3) the project is still in compliance with the Coastal Development Permit regulations, and (4) that the findings required for granting a Minor Site Development Plan and Coastal Development Permit extension can be made; therefore, the City Planner APPROVES the second extension of Minor Site Development Plan (SDP 15-23) and Coastal Development Permit (CDP 15-43)- NORTH COAST MEDICAL PLAZA for two (2) years from July 6, 2020, to July 6, 2022, based on the following findings and conditions. Findings: 1. All the findings contained in the Planning Commission Resolution No. 7178 dated July 6, 2018, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the second extension of Minor Site Development Plan SOP 15-23 and Coastal Development Permit CDP 15-43 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code and growth management program policies and standards in place at this time. 3. The project is a project for which a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program were previously adopted [15162] {City Council Resolution No. 2013-228, dated September 13, 2013); b. This project is consistent with the project cited above; c. The Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program were adopted in connection with the prior project; d. The project has no new significant environmental effect not analyzed as significant in the prior Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program; e. None of the circumstances requiring further environmental compliance under CEQA Guidelines Sections 15162 or 15163 exist; and f. The City Planner finds that all feasible mitigation measures identified in the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program, which are appropriate to this Subsequent Project, have been incorporated into this Subsequent Project. Conditions: 1. This second extension of Minor Site Development Plan SDP 15-23 and Coastal Development Permit CDP 15-43 is granted from July 6, 2020, to July 6, 2022. If building permits for this project are not obtained within this time period; the Minor Site Development Plan and Coastal Development Permit will expire on July 6, 2022, unless extended per Sections 21.58.040 and 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in the first extension of Minor Site Development Plan SDP 15-23 and Coastal Development Permit CDP 15-43, dated July 23, 2018, apply to this second extension and are incorporated herein by reference and remain in effect except for Condition No. 1, which is superseded by Condition No. l of this approval letter.
