The project, located at 3606 Harding Street, on the east side of Harding Street, north of Magnolia Avenue, was approved on January 18, 2017, and due to expire on January 18, 2019. After careful consideration of the circumstances surrounding this request, it has been determined that (1) the first extension of Minor Site Development Plan {SDP 16-12) -HARDING VETERANS HOUSING was submitted in a timely manner prior to the expiration date, (2) there has been no change of circumstances in relation to the Site Development Plan (i.e., Title 21 of the Carlsbad Municipal Code}, (3) the project is still in compliance with the Site Development Plan regulations, and (4) that the findings required for granting a Site Development Plan extension can be made; therefore, the City Planner APPROVES the first extension of Site Development Plan {SDP 16-12)-HARDING VETERANS HOUSING for two {2) years from January 18, 2019 to January 18, 2021, based on the following findings and conditions. Findings: 1. All the findings contained in the Planning Commission Resolution No. 7222 dated January 18, 2017, apply to this extension and are incorporated herein by reference and remain in effect. 2. That the first two-year extension for SDP 16-12 from January 18, 2019, to January 18, 2021 is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the General Plan and Site Development Plan regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for construction of a three-story, 26-unit apartment building designated for veterans with one manager's unit (SDP 16-12). 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 4. That the first two-year extension of Site Development Plan SDP 16-12 remains consistent with the General Plan, all titles of the Carlsbad Municipal Code, Carlsbad Village and Barrio Master Plan, and growth management program policies and standards in place at the time the extension was filed. That the City Planner has determined that rffe"pr~ct belongs to a class of projects that the State Secretary for Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to Affordable Housing-Section 15194 of the state CEQA Guidelines. In making this determination, the City Planner has found that the exceptions listed in Section 15300.2 of the state CEQA Guidelines do not apply to this project. Conditions: 1. This first extension of the Site Development Plan is granted from January 18, 2019 to January 18, 2021. If building permits for this project are not obtained within this time period, the Site Development Plan will expire on January 18, 2021, unless extended per Sections 21.58.040 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution No. 7222 dated January 18, 2017, for SDP 16-12 apply to this extension and are incorporated herein by reference and remain in effect except for Condition No. 9, which is superseded by Condition No. 1 of this approval letter.
