Lot 34 would have the lR type floor plan and Lot 35 would have the . 3 floor plan, located on Sparrow Road in Planning Area 24 of the Aviara Master Plan, in Local Facilities Management Plan Zone 19. The City has completed a review of the minor amendment to SDP 95-05 to change the floor plan types on Lots No. 34 and 35, located on Sparrow Road in Planning Area 24 of the Aviara Master Plan. It is the Planning Director's determination that the project is consistent with development standards of Planning Area 24 in the Aviara Master Plan, and therefore, APPROVES this request based on the findings and conditions contained therein. Findings: 1. The project is consistent with the General Plan since the amendment will not change the residential density of Planning Area 24 of the Aviara Master Plan, and a change in the type of floor plan on two lots will not impact land use, circulation, housing, open space, or recreation. 2. The two new floor plans on Lots No. 34 and 35 relate to the site, surrounding neighborhood, and environmental setting in that the homes meet the front, side, and ·rear yard setback, coverage, parking, and building height standards of Planning Area 24 of the Aviara Master Plan. 3. The two lots are adequate in size and shape to accommodate the homes, in that a reasonable size home, in keeping with the neighborhood, can be accommodated and still meet required development standards, and provide for positive lot drainage around the structures. 4. The proposed amendment is compatible with the surrounding neighborhood in that the same floor plans and homes have been approved and constructed on lots throughout the planning area. 5. That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, in that the amendment proposes to only change the type of home and does not add additional residential density or change the land use of the lots. 6. The amendment is consistent with the development standards of Planning Area 24 of the Aviara Master Plan, and meets all City policies and standards. 2075 Las Palmas Drive • Carlsbad, California 92009-1576 • (619) 438-1161 • • SOP 94-0S(A) Greystone Residential Development May 8, 1995 Page 2 • 7. Due to the minor nature of the amendment, it will not cause any additional environmental impacts and the Planning Director has determined that the environmental effects of the project have already been considered in conjunction with previously certified and adopted environmental documents (EIR 83-02(A) & Mitigated Negative Declaration-CT 90-15), on file in the Planning Department. Conditions: 1. All conditions of approval for SOP 94-05 as contained in Planning Commission Resolution No. 3702 shall apply to this approval and are incorporated herein by reference. 2. Approval is granted for SOP 94-05(A), as shown on Exhibit "A", dated May 8, 1995, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 3. The Developer shall provide the City with a reproducible 24" x 36", mylar copy of the Site Plan as approved by the final decision making body. The Site Plan shall reflect the conditions of approval by the City. The Plan copy shall be submitted to the Planning Director and approved prior to issuance of building permits for Lots No. 34 and 35. This Planning Director determination is final unless the determination is appealed to the Planning Commission. The appeal shall be filed in writing with the appropriate appeal fee of $490.00 and sent to the Planning Director within ten calendar days after receipt of the Planning Director determination.
