Carlsbad Ranch Specific Plan (SP 82-07) Policy 4-1 conflicts
somewhat with Policy 2-2 (D) (24) of the Mello II segment of the
Local Coastal Program because the specific plan requires the notice
to be included on all deeds of the parcels created. It is unusual
to require this type of notice in a deed. The proposal is to
include a notice in all leases and purchase agreements for Carlsbad
Ranch .. I think this sufficiently complies with the intent of the
policies.
The proposed notice should be amended to state that the property
being purchased or leased may be subject to dust, pesticides, etc.
The .<;lraft wording states that the farming operations will be
sUbject to these conditions. This could be interpreted to mean
that the offending conditions will exist mainly on the farm
property. I believe the intent is to give owners and tenants
notice that their property may be subject to these conditions.
