RESOLUTION APPROVING CHANGX IN "FREEWAY HAINTENANCE AGREEMENT, DELETING THERXFROPI THE STATE'S OBLIGATION TC MAINTAIN THY CANNON UNDEXCROSSLNG" ,
WR3RXAS the City Council of the City of Carlsbad did on the
wnd day of February, 1954, by Resolution No. 92, approve a "Freeway
Mgintenance Agreement" , which related to State Highway Boute
XI-SD-2-Cbd, and;
WEEREAS such agreement provided that the State was required to
maintain the Csnnon Road Undercrossing, and;
WHEREAS said Cannon Road is private property and not the property
of the City of Carlsbad, and:
XKZR3AS the State has requested the City's approval to a proposed
change whereby the State would not be required hereafter to maintain
the Cannon Undercrossing,
j(OW THTBSPOR3, BE IT RESOLED AND STATED that the City Council of
the City of Carlsbad has examined Sxhibit "An attached to the original
agreement, and that such Zxhibit IrAft as presently attached to the
original agreement does not show the State obligation to maintain the
Cannon Undercrossing, and that the revised Exhibit "A" is hereby
zpproved by the City Council of the City of Carlsbad,
PASSED, APPROVED AND ADOPTED this ,l-f day of .*.. 1954,
by the City Council of the City of Carlsbad.
