The City Council of the City of Carlsbad does hereby resolve as follows: That the City Manager be authorized, instructed and empowered to open an escrow at the Security Trust and Savings Bank of San Diego, Carlsbad Branch, for the purchase of that property described as: That portion of Lot 18, Seaside Lands, in the City of Carlsbad, County of San Diego, State of Califor- nia, described as follows: Beginning at the most Easterly corner of Lot 18, Seaside Lands, Map No. 1722, as filed in the office of the County Recorder of San Diego County; thence South 55O 27' West, 189.86 feet to the Southwesterly corner of Lot 18, being the Easterly right of way line of the Santa Fe Railway; thence along the East- erly line of the Santa Fe Railway 440.75 feet to the true point of beginning; thence along the Easterly line of said Railway right of way line 144.52 feet; thence North 53O 14' East, 124,15 feet; thence North Oo 21' 45'* East, 52.37 feet; thence North 89O 37' 15" East 60.89 feet; thence along the 'desterly right of way line of the California State Highway on a radius of 1160 feet through an angle of loo 58' 36'' a distance of 222.21 feet; thence North 85O 03'. West, 9.09 feet to a tangent 379.95 feet radius curve to the left; thence along the arc of said curve 78.16 feet through a central angle of llo 47' loB1 to the true point of beginning, said escrow shall provide that the City is to pay $5,000.00 for said property, that the escrow expenses shall be shared equally by the parties to the escrow, that the Seller is to furnish to the City of Carlsbad a policy of title insurance showing said property to be free and clear of all encumbrances, that Seller shall furnish to the City water stock presently appurtenant to the premises. BE IT FURTHER RESOLVED that the City of Carlsbad does hereby consent to the acquisition of such property in the name and in behalf of the City of Carlsbad and that this resolution constitutes the consent of the City of Carlsbad for the recordation 1 of a deed to the aforesaid property in the name of the City of 2 Carlsbad. 3 4 PASSED, APPROVED AND ADOPTED on this SstSay of d~me 5 1955, by the following vote: 6 AYES: @naneiAaen Heltsms, McCleElarz, Suttoa, lrfayor Me.
