HomeMy WebLinkAbout1957-01-15; City Council; Resolution 2371 2 3 4 5 6 7 8 9 10 11 12 1Z 14 1E 1E 17 1E 15 2( 21 2: 2; 2L 2: 2t 2' 24 2! 3( 3: 3: RESOLUTION NO. 237 0 A ESOLUTION OF ThX CITY COUNCIL OF THE CITY OF CARLSBN ANNOUNCING ITS FINDINGS AND DECISION REGBRDING TIE RECLASSIFICATION OF LAND FROM ZONE R-P TO ZONE C-2 OF PROPERTY LOCATED BETWEEN ROOSEVELT STREET AND MADISON STREET, AND NORTH OF GRAND AVENUE, AND ORDER- ING AMENDMENT TO 0FU)INANCE NO. 9060. WHEREAS, the City Council has received from the Planning Commission of the City of Carlsbad their Resolution No, 6; and WHEREAS, the City Council did on the 15th day of January, 1957 hold a duly advertised public hearing as prescribed by law, to consider reclassification from Zone R-P to Zone C-2 of the property described as : Lots 33, 34, 35 and the Easterly one-half of Lot 32, of Seaside Lands, according to Map thereof No, 1722, filed in the office of the County Recorder of San Diego County, July 28, 1921; and WHEREAS, the applicant €or the zone change has offered to perform certain acts and construct certain improvements, and post a bond for the performance of same with the City Council, NOW, THEREFORE, the City Council of the City of Garlsbad finds the following facts to exist: (1) that the applicant has requested the change of zone in order that the property may be used primarily for the location of a large market and parking area adjacent thereto, (2) Planning Commission to be adaptable to the subject use but no precise plan for the development of the property has been submitted by the applicant. that the proposed site has been found by the (3) Roosevelt Street, which front the subject property, are not adequate to carry the excessive traffic which will be thrown on these two streets as soon as the market commences operation. that the present widths of both Madison Street and (4) and, unless a right of way for alley purposes is dedicated by the applicant, poor traffic circulation will result. that there is no cross street North of Grand Avenue 1 2 3 4 5 6 7 e 9 10 11 12 13 14 15 16 17 1€ 3s 2c 23 22 2: 24 2: 2€ 2'; 2h 25 3( 31 3: (5) ations in the area, (6) the applicant's property will require the installation of improvements in order €or it to be utilized as an access to the applicant's property. That there are no curb or sidewalk install- That the existing alley between Grand Avenue and NOW, THEREFORE, BE IT RESOLVED that in the opinion of the City Council the foregoing facts and reasons of the City Council require that the zone change be granted to effectuate the general purposes of Ordinance No, 9060, BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby instructed to prepare an ordinance amending Ordinance No, 9060 to accomplish the zone change requested, BE IT FWTHER RESOLVED that the City Manager be, and he hereby is ordered to transmit one copy of this Resolution to Albert E. Stein, 2469 Ocean Street, Carfsbad, California.
