I1 I 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31. 32 Il RI3SOLVED by the City Council of the City of Carlsbad, that BYRL E, PHELPS be and he is hereby appointed Engineer of Work for the proposed doing of all necessary ing all of the functions provided for the office of Engineer of Work and Superintendent of Streets in the "Improvement Act of l9ll" in connection with the improvement work in the City of Carls- bad known, and to be known, as the improvement of Oak Avenue between Pi0 Pic0 Drive and a point 250 feet Westerly of Highland Drive, in the City of Carlsbad; and engineering work and exercis- €33 IT FURTKER RESOLVED, that said BYRL E, PHELPS shall act as Engineer of Work and Superintendent of Streets and is hereby employed and appointed to furnish all surveys, original drawings, maps and blue prints, including any and all such maps necessary and incident to the rights of way contemplated in the improvement work herein involved; all plans and specifications, a13 inspection work, preparation of assessment rolls, assessment diagraa and warrant and any and all other services which shall be required from the Engineer of Work under the provisions of the llImprovement Act of S911tt; and BE IT FURTK;E=R RESOLVED, that for such services the said BYRL E, PSELPS, shall receive as and for his compensation for the services so specified, and as provided by law, the following sms of money: (a) Six Per Cent (6%) of the contract price for engineering services. BE IT FlTRTHER RESOLVED, that said sum shall be based upon the contract price without incidentals; and in the event the pro- posed proceedings herein contemplated shall be defeated or for any reason fail of consummation, the said BYRL E. PHELPS shall receive the reasonable value of the services performed by him, not to exceed the sum of TWO HUNDRED DOLLARS ($200.00); and BE IT FURTHER RESOLVED, that the fees hereinabove provided to be paid to the said Engineer shall be payable as folSows: (a) Three-fourths (3/4ths) of the Engineering fee upon awarding and signing of contract for the work, (b) The balance of said Engineering fee, and other fees herein provided for, upon the confirmation of the Assessment and delivery of the Warrant, PASSED, APPROVED AND ADOPTED by the City Council of the City of Carlsbad at a regular meeting held on the /thday of February 1957, by the following vote: AYES : kyor Castorena Councilmen Helton, Bobinson, NOES : Sone ABSENT2 lone Baird and fedgerwood, of the City of-Carlsbad, Carlsbad, California, ATTEST I %LB.
