RESOLUTION NO, 24.2
RESOLUTION &?POINTING PEMON TO PREFUE ALL PROCEEDINGS,
(Assessment District No. 1-1-957)
RESOLVED, that T, Bruce Smith, be and he is hereby appointed
as attorney to prepare all resolutions, notices and other papers
and proceedings for any work and improvement that may be herefn-
after authorized by the City Council of the City of Carlsbad, for
the proposed improvement of Oak Avenue between Pi0 Pic0 Drive and
a point 250 feet Westerly of Highland Drive in said City of Carls-
bad; and
BE IT FURTHER BESOLVED, that the said T, Bruce Smith shall
receive as compensation for the doing and performance of said work
the sum of Two Per Cent (2%) of the contract price, not including
incidentals; but in no event shall the amount of compensation,
which the said T. Bruce Smith shall receive, be less than ONE
HUNDRED DOLLAFS (@.OO.OO); and
BE IT FURTHER RESOLVED, that said compensation shall be paid
as followst
(a) contract with the contractor who may be awarded said contract by this Body.
(b) Warrant, diagram and Assessment;

BE IT FURTHER IIESOLVED, that if said proceedings shall fail
to be carried through to conclusion, then the said T, Bruce Smith
shall be paid a reasonable compensation for his services, which
he has performed, not to exceed the sum of ONE JD'NDRED DOLLARS
($100.00) ; and
BE IT FURTHER RESOLVED that said services shall not include
my services for litigation or services in the procurement of
easements or rights of way, but shall be for the preparation of

all resolutions, notices and other papers and proceedings required
by the provisions of the “Improvement Act of 19Utf in carrying
through the proceedings for the work herein contemplated.
PASSED, APPROVED AND mPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 5th day of February
1957, by the following vote:
