HomeMy WebLinkAbout1957-04-16; City Council; Resolution 256-4- 1 2 3 4 5 6 7 8 9 10 11 12 1: 14 1: If 1'; 1E 15 2( 21 2: 2; 21 2! 2t 2' 21 2! 3( 3: 3: RESOLUTION NO, 256 (Assessment District No. 2-1957) RESOLVED by the City Council of the City of Carlsbad, that JACK KulBOTA be and he is hereby appointed Engineer of Work for the proposed doing of a11 necessary engineering work and exercise ing all of the functions provided for the office of Engineer of Work and Superintendent of Streets in the "Improvement Act of 1911tf in connection with the improvement work in the City of Carls bad known, and to be known, as the improvement of Sunnyhilf. Drive between Alder Avenue and the Southerly terminus thereof, in the City of Carlsbad; and BE IT FURTHER RESOLVED, that said JACK XDBOTA shall act as mirzeer of Work and Superintendent of Streets and is hereby employed and appointed to furnish all surveys, original drawings, maps and blue prints, including any and all such maps necessary and incident to the rights of way contemplated in the improvement work herein involved; all plans and specifications, all inspection work, preparation of assessment rolls, assessment diagram and warrant and any and all other services which shall be required fro the Engineer of Work under the provisions of the nInprovenent Act of J.911u; and BE IT FURTHER RESOLVED, that for such services the said JMK KUBOTA, shall receive as and for his compensation for the services so specified, and as provided by law, the sums of money hereinaiter set forth, which sums of money shall be paid by the said JACK KUBOTA into the General Fund of the City of Carlsbad, said sums of' money being more particularly set forth as followsr: (a) Six Fer Cent (6%) of the contract price for engineering services. (b) Two Fer Cent (2%) of' the contract price for preparation of Assessment, Assessment ROU, Assess- ment Diagram, and Warrant; and BE IT FURTHER RESOLv3ED, that said sun shall be based upon the contract price without incidentals; and in the event the pro- posed proceedings herein contemplated shall be defeated or for any reason fail of consummation, the said JACK KUBOTA shall receive the reasonable value of' the services performed by him, not to exceed %he sum of TWO HUNDBED DOLLARS ($200.00); and that upon receipt of such sum of money, that said JACK KUBOTA shall pay the funds into the General Fund of the City of Carlsbad; and BE IT FURTHER RESOEVED, that the Tees hereinabove provided to be paid to the said Engineer shall be payable as follows: (a) upon awarding and signing of contract for the work. (b) The balanee of said Engbeerfng fee, and other fees herein provided for, upon the confirnation of the Assessment and delivery of the Warrant. PASSED, AFPROVED AND ADOPTED by the City Council of the Cftg Three-fourths (3/4$hs) of the Engineering fee of Carlsbad at a regu3.ar meeting held on the 16th day of April, by the following vote, to wit8 AYES: Ledgerwood, Castorena and Baird BOBS: None BBSENT: None ABSTAINING: Robinson and Belton fl E of the City of Carlsbad, Carlsbad, California 7k6Q-L & M. 0.
