&RESOLUTION V&CATING A PORTION OF CHESTNUT AVENUE BETWEEN A PROLONGATION OF TNE WTEBLY LINE OF JZFTERSON STREE2 AND THE PROLONGATION OF THE WESTEW LINE OF Hk6RDING S-; AND FTJRTIlER VWATING THE ALLEY LYING BE!A#EZN CHESTNUT AVXNUE AND PlEllIsIz AVENUE; ORTIEZING CLESK TO RECORD A CERTIFIED COPY WITH THE COUNTY

WHEUNS, on the 7th day of play, 1957, the City Council of
the City of Carlsbad adopted Resolution No. 260, stating its, inm
tention to vacate the property herein vacated, and setting a time
and place of hearing; and
WHEREAS, the City Engineer has posted notices stating stree
vacation and date of hearing in accordance with the provisions of
Section 8332 of the Streets and Highway Code of the State of
California; and
WHERXAS, at 7:20 P.M. on the 4th day of June, 1957, the
City Cotmcil of the City of Carlsbad held a hearing at itYs
regular meeting place in the City of Carlsbad at 2960 Pi0 Pic0
Boulevard; and
WHEBW, no persons who were interested in or opposed to
the street vacation submitted any oral communications and further
that no persons made any oral pmotests at said hearing, now,
therefore,
The City Council of the City of Carlsbad does hereby
resolve as follows:
The City Council of the City of Carlsbad does hereby vacate
that portion of Chestnut Avenue between the prolongation of the
Easterly line of Jefferson Street and the prolongation of the
Westerly line of Harding Street, and the alley line between
Chestnut Avenue and Palm avenue in accordance with the map attache
hereto, marked Exhibit ttA1l, and by reference thereto made a part
of this Resolution; EXCEPTING THFBEF'ROM:

wise, to construct, maintain, operate, replace, remove,
renew and enlarge lines of pipe, conduits, cables, wires,
The permanent easement and right of way at any time,
or from time to time, to construct, maintain, operate,
replace, remove, and renew sanitary sewers and storm
drains and appurtenant structures in, upon, over and
poles and other convenient structures, equipment and
fixtures for the operation of gas pipe lines, telegraphic
and telephone lines, and for the transportation or dis-
tribution of electrical energy, petroleum and its products,
water, and incidental purposes, including their access
and the right to keep the property free from inflammable
materials, and wood growth, and otherwise protect the
same from all hazards in, upon and over the street or
part thereof herein proposed to be vacated.
BE IT FURTIBE FUWOLVED AND ORDERED that the City Clerk
shall be and he is hereby instructed to certify a copy of this
resolution, attest to the same under the seal of the City of
Carlsbad, and to cause such certified copy to be recorded in the
office of the County Recorder of San Diego County.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City Council held on the 4th day of June, 1957, by the following
vote:
AYES: Ledgerwood, Robinson, Castorena, Helton, Baird.
NOES: NOWE
