RESOLUTION NO. 287
RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF CARLSBAD, CALIFORNIA,
ORDERING THE CONSTRUCTION OF CER-
TAIN SEWER WORK AND ORDERING POST-
ING AND PUBWCATION OF NOTICES
INVITING SEALED PROPOSALS OR BIDS.
(Assessment District No. 2-1957)
WHEREAS, this City Council on the 3rd day of September, 1957,
adopted its Resolution No. 282, declaring its iniention to order the constmction
of certain sanitary sewers and appurtenances and appurtenant work to be done
or improvement to be made under and pursuant to the Improvement Act of 1911,
Division 7 of the Streets and Highways Code of the State of California; and
WHEREAS, said Resolution No. 282 was duly published and notices
of the passage thereof were duly posted and mailed, and affidavits of publication
posting and mailing have been duly filed; and
WHEREAS, at the time and place fixed in said Resolution No. 282, a
hearing was duly held by this City Council a+ which all protests or objections
were presented, if any, and this City Council gave all persons present an
opportunity to be heard in respect of any matter relating to the work proposed
in said Resolution No. 282 or the boundaries of the assessment district describe
therein, or in any way relating to the proceedings proposed by said Resolution
No. 282; and
WHEREAS, all such persons desiring to be heard have been heard by
this City Council; and
WHEREAS, protests have not been made by the owners of more than
one-half of the area of the property to be assessed for the work or improvement
and all protests and objections have been overruled and denied by this City
Council, and this City Council has acquired jurisdiction to order the work
described in said Resolution No. 282.
NOW, THEREFORE, the City Council of the City of Carlsbad, California
DOES HEREBY RESOLVE, DETERMINE AN ORDER as follows:
Section 1. That the public interest and convenience require and the City
;ouncil of said city hereby orders the following work to be done or improvement
o be made, to wit: A11 that certain work or improvement described in said
tesolution No. 282, on file in the office of the City Clerk of said City.
:nce is hereby made to said Resolution No. 282 and to plans (which include pro-
iles and detailed drawings) for said work which are designated "Plans for
:onstruction of sanitary sewer system and pumping station in Assessment
Refer-
Xstrict 2-1957", on file in the office of the City Clerk of said City, and to
Lpecifieations for said work which are designated "Specifications No, 2-1957",
tlso on file in the office of said City Clerk, for a more particular description
bf said work and for the grades at which such work shall be done.
Section 2. That this City Council has determined and declared that said
:ontemplated work hereinbefore mentioned , in the opinionoof this City Council,
s of more than local or ordinary public benefit, and this City Council has made
he expense of said work chargeable upon a district, which district this City
Zouncil has declared to be the district benefited by said work and to be assessed
o pay the cost and expense thereof.

For the particular description of said
Section 3, That this City Council determines and declares that serial
bonds, bearing interest at the rate of six per cent (6%) per annum shall be
ssued to represent each assessment of twenty-five dollars ($25) or over
memaining unpaid for thirty (30) days after the date of recordation of the warranl
hid serial bonds shall extend over a period ending nine (9) years from the
second day of January next succeeding the next October 15th following their date
;aid bonds shall be issued under the Improvement Act of 191 1, Division 7 of the
itreets and Highways Code of the State of California, and pursuant to Section
,464 of said Streets and Highways Code, this City Council hereby elects and
letermines that the redemption provisions of said bonds shall provide for a
Iremium of five per cent (57%) of the unpaid principal of said bonds tx, be paid
LS provided in said Section 6464.
Section 4. That said work and all proceedings therefore shall be done
tnd performed under and in accordance with said Improvement Act of 19 11.
Section 5. That the City Clerk of said City is hereby directed to post

conspicuously for not less thdn five (5) days on or near the chamber door of
this City Council, in the manner and form required by law ,anatice inviting
sealed proposals or bids for doing said work ordered hereby, and said City
Clerk is hereby directed to publish twice in THE CARLSBAD JOURNAL, a
newspaper of general circulation published and circulated in said city, notice
inviting such sealed proposals or bids for doing said work and referring to
the specifications on file in the office of said City Clerk, and said notices
shall contain the matters and things required by law.
opening of bids shall be 7:30 o'clock P.M., November 5, 1957, and proposals
or bids may be delivered to the City Clerk of said city up to that hour.
The time fixed for the
PASSED, APPROVED AND ADOPTED on the 1st day of October, 1957,
by the following vote, to wit:
AYES: Mayor Castorena, Councilmen Ledgerwood, and Hexton.
NOES: None
ABSENT: Councilman Baird
ABSTAINING : Councilman Robinson
