S»lf S7) 12 13 14 15 Til* City Council of the City of Carlsbad, California, DOES HEREBY 16 RESOLVE. DETERMINE AND OR DEE as followa: SECTIQH 1. That the public interest and convenience require and that 18 it i§ the intention of the City Council of said City of Carlsbad to order the following work to be done or improvement to be made in the «aid City of Carlsbad, 20 The construction of sanitary sewer a and appurtenance*, and appurtenant on Pine Avenue from it* intersection of Basawood Avenue to the inter- 23 »ection with Highland Drive, with the exact nature, extent and location of 24 improvement to be in accordance with detailed plans on file with the City Clerk of tile City of Carlsbad, containing one (1) sheet entitled "Plans for the construe)' 26 tioB of a sewer o»s Pine Avenue from its intersection of Bass wood Avenue to 27 the intersection with Highland Drive". Tit* estimated coait of said work or improvement, inclusive of incidental 29 expenses, i* the »am of £6,594^83 30 SECTIOM 2. That ail the aforesaid work or improvement »haU be constructed at the grades, along the lines, between the points, of the dimension^, at the places and ia the manner shown on this plans (which include profiles and 1 detailed drawiags) for said work, designated "Plans for the construction of 2 t, sewer on Pine Avenue from its intersection of Basswood Avenae to the intersection with Highland Drive", consisting of one sheet numbered I, and to accordance with said plans and with the specifications for said work, which are designated "Specifications No. 3-1957". Said plans ami specifications were heretofore approved by this City Council, and are on file ia the office of 7 the City Clerk of said city ia the City Hall ia said city, and reference in hereby • Q made to said plans and specifications for the fall and detailed description of 9 said proposed work and for a description of the grades at which said work is 10 to am acm*. 3. That in the opinion of this City Council the amid contemplated to be done. 11 22 23 24 25 26 27 28 29 30 31 32 12 work is of more thaa local or ordinary public benefit and this City Council her makes the expense of said work chargeable upon a district, which district this : City Council hereby declares to be the district benefited by said work and to .be assessed to pay the cost and expense thereof. For a description of said "] fi district reference is hereby made to a. plat or map of said district heretofore 17 approved by this City Council, on file in said office of the said City Clerk 18 | and designated "Map of Assessment Bltitrfat Mo. 3-19S7", which ra&p or indicates by a boundary line the extent of the territory included in the 20 proposed district and shall govern, for all details as to the extent of said 21 assessment district. 8gCTtpN4. That serial bonds bearing late rest at the rate of six per •v .,•- *--• •v;;_'i ceat (6%) per annum shall be issued to represent each assessment of tweaty- five dollars ($25.00) or over remaining unpaid for thirty (16) days after the date of recordaticn. of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day &i January next succeeding the next October 15th following their date. Said bends are to be issued pur* auant to awl as provided in the Improvement Act of 1911» Division ? of the Streets and Highways Code of the State of California, and pursuant to the provisions of Section 6464 of said Division ? this City Council hereby elects and determines that the redemption provisions of said bonds shall provide for a premium of five per cent (5%) of the unpaid principal of said bonds to be paid •*- by 30 as provided in said Section 6444 and in said Division 7. SECTION S. That the said proposed work is to be done under and pro* ceedings therefor are to be under and pursuant to the said Improvement Act of SRCTIOH>. That notice is hereby given that the 3rd day of December, 1957, at the hour of 7:30 P.M. is the day and hour when, and the Council Chambers of this City Council in the City Hall in said City of Carlsbad is the place where, any and ail persons having any protest or abjection to said proposed work or to the extent of said assessment district, or to the proposed 10 grades* may appear before the City Council of said city and show cause why said proposed work should not be carried out in accordance with Ibis resolutio 12 of intention. Protests or objections must be in writing and must be delivered to the said City Clerk not later than the hour herein set for bearing protests or objections. SECTIOH 7. THE CARLSBAD JOURNAL, a newspaper of general cir- culation published and circulated in the said City of Carlsbad and in toe County of San Diego, California, is hereby selected as the newspaper in which this 13 resolution snail be published and, except when otherwise ordered by this City Council, in which ail other publications in the proceedings pursuant to thi 20 resolution of intention snail be made. The said City Clerk is hereby directed to certify to the adoption of this resolution and to cause said resolution to be published in the manner provided by law. 23 SECTION 8. The said City Clerk is hereby directed to mail notices 24 of the adoption of this resolution as provided in said Improvement Act of 1911, 2 ^ postage prepaid* to all persons owning real property which is proposed to be 26 assessed to pay any part of the cost of said work, whose names and addresses appear on the last equalized assessment roll or as known to tike said City Cler 28 including the mailing of such notices to every owner of propery assessed by 29 the State under Section 14 of Article XUI of the Constitution at the address thereof shown on the last board roll transmitted to the County Auditor. 31 SECTION 9.
