Z", SETTING FORTH REASONS OF THE CITY OF CARLSBAD FOR DESIRING SUCH ANNEXATION; AND FIXING A TIME AND PLACE FOR HEARING OF OBJECTIQNS FOR PROPOSED ANNEXATION. WHEREAS, the City of Carlsbad has heretofore received written reques-l from a portion of the property owners in the area proposed to be annexed, requesting the annexation of the lands hereinafter described; and WHEREAS, the City Council of the City of Carlsbad has by motion in-. structed the administrative officers of the City of Carlsbad to prepare annex- ation proceedings; and WHEREAS, the boundaries of the proposed annexation have been submitted to and reported upon by the Boundary Commission of the County of San Diego; and WHEREAS, the Boundary Commission of the County of San Diego has approved the boundaries of the proposed annexation; and WHEREAS, the City Clerk of the City of Carlsbad has certified to the City Council that the territory proposed to be annexed is uninhabited, now, therefore, The City Council of the City of Carlsbad DOES HEREBY RESOLVE as follow s : IT IS HEREBY DECLARED that the City Council of the City of Carlsbac that proceedings for the annexation hereinafter described have been initiated by the City Council of the City of Carlsbad; that the City Council does hereby declare their reasons for initiating such proposed annexation to be as follows: 1, proposed to be annexed, adjacent to the City of Carlsbad, may be That the City of Carlsbad is apprehensive that certain lands, used in such a fashion so as to be contrary to the best interests of the City of Carlsbad. 1 2 2 G 4 f; 8. That the area proposed to be annexed is required to be in BE IT FURTHER RESOLVED AND FOUND by the City of Carlsbad that the boundaries of the territory proposed to be annexed by the City of Carlsbad are as follows: 411 that portion of Rancho Agua Hedionda, Map No. 823, on record in the Recorder's office of San Diego County, State of California, lying within the following described boundary: (1) Beginning at the intersection of the southerly line of Lot H of Rancho Agua Hedionda with the easterly line of the right-of-way of the Atchison, Topeka, and Santa Fe Railway Company; (2) Thence easterly on the south line of Lo2 H, Rancho Agua Hedionda North 89' 59' East (North 89 Record) 292.56 feet (292.96 feet record) to the Southeast corner of that land annexed to the City of Carlsbad by their Ordinance No. 1053 adopted on the 20th day of August, 1957, and the TRUE POINT OF BEGINNING; 55' 30" West Deed (3) Thence continuing easterly along said south line of Lot H, Rancho Agua Hedionda 11 17.71 feet to a point; Thence North Oo 01' West 1558.90 feet (deed record 1573 feet) to a point; Thence westerly along a line parallel to the south line of Lot H, Rancho Agua Hedionda 11 17.71 feet to a point; (6) Thence South OoO1' East 1558-90 feet (deed record 1573 feel to the TRUE POINT OF BEGINNING. (4) (5) BE IT FURTHER RESOLVED that the territory herein proposed to be annexed shall be, and the same is hereby designated "SOUTH CARLSBAD ANNEXATION # 1.2". BE IT FURTHER RESOLVED AND DECLARED that hearing will be -2 - 1 2 1 c 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 held on Tuesday the 17th day of December, 1957, at the Council Chambers in the City Hall, 2960 Pi0 Pic0 Drive, Carlsbad, California, at the hour of 7:30 o'clock P.M., for the purpose of hearing persons interested in or ob- jecting to the proposed annexation. At any time before the hour set for hearing, objections of any owner of property within the territory proposed to be annexed may file written protest against the annexation. The written protest shall state the name of the owner of the property affected, and the description and area of the protestant's property in general terms. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to publish this resolution twice in the Carlsbad Journal, published in Carlsbad, California, and also in the Blade -Tribune, published in Oceanside, California, on November 7, 1957 and November 14, 1957; The City Clerk is further directed to cause written notice of the proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed, is assessed in the last equalized County assessment roll available on the 5th day of November, 1957, at the addresses shown on each assessment roll or as known to the Clerk, and also to any person who has filed his name and address and designation of the lands in which he has any interest, either legal or equitable, with the Clerk. The City Clerk is further directed to camse written notice of this proposed annexation to be mailed to the Board of Supervisors of the County of San Diego. to cause written notice of this proposed annexation to be mailed to the Carlsbad Union Elementary School District, Oceanside-Sarlsbad Union High School District, Carlsbad Municipal Water Improvement District No. 1, Carlsbad Municipal Water District, Metropolitan Water District of Southern California, San Diego County Water Authority and Agua Buena Soil Conserva- tion District; and the notices heretofore required to be given by the City Clerk shall be completed on or before the 21st day of November, 1957.
