RESOLUTION NO. 329
RESOLUTION OF INTENTION TO AMEND
SECTION 1912 OF ORDINANCE NO. 9060, SAlDSECTION RELATING TO THE VOTE OF THE CITY COUNCIL REQUIRED TO
AMEND ORDINANCE NO, 9060, REFERRING
THE SAME TO THE PLANNING COMMISSION
FOR HEARINGS AS REQUIRED BY LAW,
The City Council of the City of Carlsbad does hereby resolve as follows:
SECTION 1. The City Council on its awn motion does hereby declare
its intention to initiate an amendment of Section 1912 of Ordinance No. 9060
by changing said section to read as follows:
"SECTION 1912. DECISION OF CITY COUNCIL SHALL BE FINAL.
The action of the City Council (regardless of whether or not it be
an approval, reversal, modification, or amendment of the action
of the Planning Commission) on the application for amendment
shall he effected by at least three (3) affirmative votes of members
of the City Council, which action shall be final and conclusive".
SECTION 2. The City Clerk is hereby directed to cause this resolution
of intention to be forwarded to the Planning Commission, who shall hold
hearings upon such matter as required by Section 1903 of Ordinance No. 9060
of the City of Carlsbad.
PASSED, APPROVED AND ADOPTED by the City Council of the City
of Carlsbad at a regular meeting held on the 7th day of January, 1958, by
the following vote, to wit:
AYES: Mayor Castorena, Councilmen Ledgerwood, Robinson and Heltc
NOES: None
ABSENT: Councilman Baird
of the City of Carlsbad,
Carlsbad, California
