WHEREAS, on the 4th day of February, 1958 , the City Council of the City of Carlsbad adopted Resolution No. 339 entitled as fo1lows:"A RESOLUT DESCRIBING CHANGES PROPOSED TO BE MADE IN RESOLUTION NO. 299(RESOLUTION OF INTENTION RE ASSESSMENT DISTRICT NO. 3-1957 DECLARING NO ESTIMATED INCREASE IN COST OF WORK, GIVING NOTICE OF TIME AND PLACE OF HEARING."; and WHEREAS, on the 6th day of February, 1958, the notice of public hearing required by said resolution was duly published; and WHEREAS, on the 18th day of February, 1958, hearing was duly had in accordance with the requirements of Resolution No. 339, NOW, THEREFORE, the City Council of the City of Carlsbad does hereby resolve as follows: SECTION 1. It is hereby found that notice has been duly given in accordance with Resolution No. 339. SECTION 2. It is further found that no persons appeared at the hearin held at 7:30 o'clock P.M. , February 18, 1958, in the City Hall Chambers of the City of Carlsbad at 2960 Pi0 Pic0 Drive, and objected to the proposed change. SECTION 3. IT IS HEREBY ORDERED that Section 4 of Resolution No. 299 is hereby repealed and the following section substituted in its place and stead: "SECTION 4. That serial bonds bearing interest at six percent (6%) pt annum shall be issued to represent each assessment of $50.00 or over remaining unpaid for over thirty (30) days after the date of confirmatiol of the assessment. Said serial bonds shall extend over a period ending nine (9) years from the 2nd day of January next succeeding the next October 15th following their date. Said bonds are to be issued pursuant 1 2 1 (. 4 F t r E I 1( 1: 1: 1: 1, 1 1 1 1 1 2 2 2 '2 2 2 2 2 2 2 2 'j c i 4 to and as provided in the Improvement Act of 1911, Division 7 of the State and Highway Code of the State of California, and pursuant to the provisions of Section 6464 of said Division 7. This City Council hereby elects and determines that the redemption provisions of said bonds shall provide for a premium of five percent (5%) of the unpaid principal of said bonds to be paid as provided in said Section 6464 and in said Division 7. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council held on the 18th day of February, 1958, by the following vote, to wit: A YES: Vice Mayor Helton, Councilmen, Robinson, Ledgerwood and NOES: None Baird.
