The City Council of the City of Carlsbad does hereby resolve as follows:
The Mayor is hereby authorized and instructed to sign for and in behalf
of the City of Carlsbad that particular’lamendment to agreement for purchase’:
a copy of which is attached hereto; and the City Clerk is hereby ordered to
attest to such signature and to affix the seal of the City of Carlsbad.

RESOLUTION NO. 364
A RESOLUTION TO AMEND THE AGREEMENT
BETWEEN THE CARLSBAD MUTUAL WATER
COMPANY AND THE CITY OF CARLSBAD BY DELETING THEREFROM PARAGRAPH 11 (c),
THE EFFECT OF SUCH AMENDMENT BEING
TO ELIMINATE THE REQUIREMENT OF A JUDICIAL DETERMINATION OF THE POWERS
OF THE RESPECTIVE PARTIES TO ENTER
INTO AND CARRY OUT THE TERMS OF THE ORIGINAL AGREEMENT.

AYES: Mayor Baird, Councilwoman Sonneman, Councilman Welton and
NOES: None Lough.
